    I don't think it will, I think that the owner of the car will need to sue for losses.
    The best solution IMO is that the dealership replace the car with a similar one. OP have you tried this approach?

    I think that mechanic who crashed it did you a huge favour...
    Buying a car on finance does not guarantee that the car will be free of faults during the period of finance. What was the fault ('red light screaming') that you got fixed under warranty?
    The fact that you have owned it 'only a year' is irrelevant if it's already got a decade of use on the clock. Your expectations of what to expect from a 10 year old vehicle with a poor reliability record are unrealistic.
    No free lunch, and no free laptop ;)
