Lowell On Credit File

Hi

I have been having difficulty dealing with Lowell solicitors ltd.

They have an entry on my credit file that is incorrect and I want it removed.

Lowell issued a CCJ in December 2016 (December 20th) Luckily I sent a response to the court stating that I have had no correspondence or details from Lowell regarding this account. I asked for the judgement to be set aside and it was. Lowell never provided any relevant information except it was from Three mobile (I have no record of owing three any money and I would of certainly paid them £75 if I had owed that)

Lowell sent me a letter in February saying they believed this debt was owed by me but they would not be chasing the matter any further.

Question is how do I get this removed from my credit file as there is no evidence what so ever that I owe this money.

Some relevant info:
My bank card was cloned back in 2009 and I had all my money withdrawn and somebody purchased 2 phones and booked a hotel in Watford (whilst I was making a ATM withdrawal in Woolwich, my bank refunded all my money, so I assumed this phone account was because of this

I do not have any evidence of this as I did not report it to the police and I was just happy I got my money back.

I have written another letter to Lowell requesting they provide evidence of this defaulted account if they cannot then I have demanded they remove the account from my credit file.

Is there anything I can do to get the account removed from my credit file? as I getting really fed up with this as it has been going on for 2 years.

I never really had been bothered until now as I need to pass a vetting clearance, one of the questions is Have you ever defaulted an account? I have not but this Lowell account says I have.

    Just for more info. There is no record of a Three Account On My credit file for the last 6 years. (On Noodle)

    Written complaint to Lowell asking them to remove said default.

    If they refuse, your next step is to escalate to the information commissionaire (ICO).

    They deal with matters pertaining to credit files and wrong information.

    When did you write? There are timescales as to how long they have to respond, if you have only just written because a vetting has turned up, it may not all be done in time.

    If the account was opened in 2009, why did it take them 4 years to apply a default?

    Is there a bunch of green zeros from 2009 to 2012 or so? If yes, who was paying the bill? If not, then the account should have defaulted in 2009/10.

    You need to check all 3 of your credit files:

    Experian: https://www.moneysavingexpert.com/creditclub
    Call Credit: https://www.noddle.co.uk
    Equifax: https://www.clearscore.com

    You should write a complaint letter to Lowells and ask them to amend the default date to 2009/10. If they do this, it will be removed from your files because the 6 years would have been up in 2015/6.

    Suggestion for the team :
    Is it worth the OP contacting Three mobile ?
    If they have no record, they can write to Lowell, and ask why they are defrauding the OP in their name.
    If they do, the OP can ask why the demand wasn't made in the 6 year time-limit. If phones were involved, there may be call records.

    I doubt it. Its a mobile contract and many providers purge details due to the age of the accounts and only keep certain details. As to call records, unless itemised billing was paid for then records are not kept.

    I was going to suggest something similar. It may be from the OP's fraud, or it may not but it could be hassle trying to get it looked at and stating the default date is wrong would simply mean the date falls off credit files. If there has been no acceptance of debt since the last payment to 3 then the default date is wrong.
