Won miss sold endowment was in joint names before we cashed Ex is now dead

Can anyone throw any light on my question. I just received a call from Mcas saying I won my claim for missold endowment years ago.taking 45% though. I need to send in my ex husband death Cert as policy was in joint names before we divorced. The money was always paid by me through my own bank account and for a year while we were separated and waiting for divorce to finalise. My ex then remarried an awful woman who we believe led him to an early grave. Do I get the balance after company takes its share or will they make me split it with his widow?

    Of course if you had kept the policy going and it was still in force when your ex unfortunately passed away you would have received 100% of the sum assured.

    Whoever employed EMACs is responsible for the whole bill. Not a share of it. i.e. if you employed them and your ex was not involved, then you are the one that is required to pay their charge. Your ex's estate should receive their 50% of the redress without the EMACs charge deducted.

    If your ex was party to the EMACs contract (i.e. jointly signed) then you would split the fee. If it was just your ex that was in contract with them EMACs should make a claim against the estate and you keep your full 50%.

    Redress does not normally go to the claims company (it can in rare cases but it shouldn't).

    Thanks I put in claim after ex husband died. No estate. His new wife of 2 years claimed all his pensions etc and didn't give our 5 children any money. She was quite nasty to them and myself. The policy was taken out when we were married total of 28 years but was cashed in when we divorced. I have always made monthly payment from my account beening the sole earner as it was ment to pay of the mortgage. I agreed on divorce to cash it in and gave ex half, although told I didn't need to as I never asked for any maintenance from him. The children agree with me she shouldn't get any and she doesn't know about it as it was well before her time. Fingers crossed it goes ok
