What those sections of legislation ultimately mean is that any information provided on the characteristics of the goods forms part of the contract. It is highly likely that the auction house provided no such information.
The information prescribed by the CCRs only needs to be provided if the "information is not already apparent from the context" of the sale (CCRs 9(1)). In an auction the characteristics of the goods are established by the buyer viewing them prior to bidding. The catalogue no doubt contains a suitable caveat to that effect.
The other consideration to be aware of is that the OP has a contract with the seller, not the auction house, so any information provided by the auction house cannot be considered pre-contract information because no contract exists between the OP and the auction house.
Almost but not exactly.
While the buyer usually isn't buying from the auctioneer (sometimes they do own the goods they're punting but usually not), they can still rely on statements made by the auctioneer and the auctioneer must not make any false statements about the goods.
Whether their description of "3 shades class c" is false or not, remains to be seen. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
This assumes that boards from different brands/manufacturers will physically connect/clip together
I suppose thats why the poster asked OP if they could rather than stating that the OP couldYou keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Had the OP received a "palette" of laminate wood, rather than a "pallet" of laminate wood, she definitely would have something to complain about.
I would still like to know how much she paidIf you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0 -

... and THAT assumes that the OP can't use a saw ...
I mean: since when did random wood offcuts, or pallet wood, clip together? Wood is wood. If the tongue/groove or whatever smart stuff they've added won't inter-mix, lop it off. It's still laminate flooring0 -

Not all clip type of flooring is the same. In fact there is quite a difference across manufacturers in the types of system involved.0

This laminate 'bargain' has literally me sick! Taken ill & ended up in A&E as my foot and ankle swelled to an enormous size for no apparent reason. Diagnosed with cellulitis ( bacterial infection of skin and underlying tissue)caused by scratching my foot on a laminate plank. The scratch was so tiny & insignificant that I never dreamt it could be the cause of the swelling etc.
As a result , I have been to unwell to make complaint to Auction House and am only now catching up on further replies and am trying to get my ' head around ' replies which indicate my understanding of/application Consumer Regs is faulty in the context I describe.
My house is larger than I can afford to maintain & I'm devoting all my time and effort at completing the most needed improvements prior to putting it up for sale. To be honest I'm feeling very weary and wondering if I should just ' cut my losses' and put my 'laminate fiasco' down to experience?0 -
