Hello,
This is my first time posting here so please bear with me.
So I have recently made huge changes and had a long word with myself with regards to my debts and by the end of June I will actually be debt free!
However I have a CCJ from Robinson Way regarding and ex Lloyds Bank account, it was a default judgement made against me in May 2015. I don't ever recall receiving the Court Papers however I may have received them and been stupid enough to bury my head in the sand and ignore them thinking they will go away and not thinking of the effect it could have in the future. I know, I know I'm an idiot. Possibly.
When I found out about the CCJ I called Robinson Way and they told me that the Court Papers were sent to such and such address, which actually was not my address and never had been. I raised a complaint blah blah blah and the outcome was that Robinson Way said that they were sent to my actual address. I have requested copies of the Court Papers but so far have not received them.
Anyway as part of the complaint I requested my statements from Lloyds, and looking at them I became overdrawn due to returned direct debit fees and overdraft interest fees. Over the last six months Robinson Way have continuiously stated that the debt was due to an overdraft I had had and I have not questioned it. However I never had an arranged overdraft with them, and the entire debt is due to charges and interest.
Is there anything I can do about this? I have paid some of the debt off as I so want to sort myself out I was just going through my debts and paying them, does my payment mean that I acknowledge and accept the debt as accurate and fair? Would Lloyds actually do anything about this or even look in to it? I don't want any money from them, in an ideal world I would like it to be looked at and the CCJ to be set aside so I could then put in my defence. But I am very aware that this is not an ideal world and unicorns aren't real.
I've been stupid in the past with money and am now paying the price, I realise that one of those prices is accepting a CCJ if I have to, however if I am able to challenge it and get a better outcome I will. The CCJ has a massive impact on my credit file and any potential mortgage applications so if I can change it I would like at least try.
Any advice would be great and if you need more info please let me know!
