    I've never understood why airlines don't ask for a response from passengers when they are advised either directly/ indirectly about flight changes, a simple link to manage my booking to confirm they are aware of the change would suffice.

    The court decision does not say the airline must contact every customer directly at all and for bookings through agents it is unlikely to have any contact details anyway. Agents keep customer details to themselves as they feel airlines would try and get customers to book direct next time.

    What the judgement actually says is that if customers do not get the 14 days notice despite the airline telling the agent more than 14 days before departure, they are still liable to pay compensation but they can demand the agent pay them back if they fail to notify the customer in time. It just reinforces the concept that a travel agent acts as an agent of the airline and the airline has to therefore take responsibility for any failure on the part of the agent. Hopefully bad agents, some of whom appear here with regularity will lose their agency agreement if airlines have to pay out too frequently, or maybe that is just my wishful thinking!

    It says liability for the failure to inform the passenger rests with the airline in the first instance (whom the passenger can sue) but any breach of contract between the travel agent and the airline (which will presumably now include an obligation to pass schedule changes on) can be followed up by the airline.
