What the judgement actually says is that if customers do not get the 14 days notice despite the airline telling the agent more than 14 days before departure, they are still liable to pay compensation but they can demand the agent pay them back if they fail to notify the customer in time. It just reinforces the concept that a travel agent acts as an agent of the airline and the airline has to therefore take responsibility for any failure on the part of the agent. Hopefully bad agents, some of whom appear here with regularity will lose their agency agreement if airlines have to pay out too frequently, or maybe that is just my wishful thinking!
