Hi hope someone can help me
i have tied reading the forum but have dyslexia and am going in cerculs. hope you dont get mad for me posting about this when it says to read everything, not sure wich parts i would follow in my case
been receiving letters from zzps about a parking charge notice, says it happend 19/01/17 00.00.
called them as i dont remember getting a fine and if i had would of paid it, yes im one of those that do if its valid
Told them i dont know about the ticket and dont believe i had had any letters from civil enforcement but now receiving letters requesting £180. I also would not have parked there at 00.00 as its my work. Ask for evidence that i received a ticket but they said because they have already decided to take legal action they cant release any evidence only the solicitors can... but it hasnt been pasted to them yet. they are telling me i have to wait till it goes to them and get more money added before i can request evidence
Where do i go from here

I no it says to ignor the debt letters but if it goes to next stage if i will have any chance of winning and what i would say, or should i just pay?

If things progress you have a very good chance of winning with help from here.

Never, ever, ever ring a debt collector. Continue to ignore them and see what happens.

Thanks. i didnt know not to ring them until i read it after. just worried that if i ignor them and it goes to court i might not win just by saying i didnt know anything about it and they would not send evidence
dont want to end up paying more

It is a bit of a gamble but if you do lose in court it actually adds very little to the cost at this stage. There is also a good chance court can be avoided.

You certainly don't engage with or pay debt collectors, they inflate the cost by adding their own silly fees, which you don't pay if they hand it back to the parking company when you ignore them.

If this progresses to the issuing of court papers and you're going to struggle to deal with them, do you have a friend or relative who can work alongside you on your computer to help you through this? It can be quite detailed to deal with.

Line them up now, not when the pressure mounts and deadlines kick in.

Yes i should be able to find someone to help me in future
because i have already called zzps i was thinking of sending them the rebost response from the newby sticky telling then i wont be paying then sending civil enforcement a letter asking them to concder the apeal outside the dead line as i didnt recieve anything from them. would there be any point in this or just wait?

I know im probably just going to be told to ignor them based on what i read, but what i really want to know is that if this goes court will i stand a chance of winning based on me not recieving the letters and the debt people refusing to send me evidence

YES - IGNORE the debt collectors

never ring them , never contact them , just IGNORE THEM

the debt people do not have to send you proof of anything , nobody does , they can allege whatever they like and not provide one shred of proof , its all smoke and mirrors

the only company who may issue an MCOL is the actual PPC themselves , it is this company that will need to provide enough proof to convince a judge in the small claims court , which MAY include actual proof of postage , not proof that the letters arrived

nobody can tell you the liklihood of it going to court (especially when you have not named the parking company involved)

nobody can tell you your chances of winning either , court is a lottery and nobody can give you this wednesdays winning lottery numbers for the same reason

there are too many issues that need resolving in a court case and not even the parking company can be sure of winning , hence these scare tactics

and come back if you get an official LBC or an MCOL in the post from Northampton (in the next 6 years)
