Where to get P45 from?

My son attended a meeting at work on 29th March to be told he was being made redundant as of 30th March. He was also told the company could not pay him any wages owed due to the financial situation they were in. The company is deciding whether to go down the insolvency route. I informed housing benefit of the change of circumstance and they asked for a copy of his P45. This is where we are struggling. As of yet, NO P45!! He's been in contact with one of the trustees who has said the P45s were sent out on Friday. The same trustee has been to the place of work today and it's still not arrived!! My housing benefit has now been suspended from 1st May and will be closed on 11th June if no P45. My son hasn't yet signed on as he's hopeful he will find work. But he couldn't if he wanted to because he has no P45. Is there anywhere else he can get a copy of this from? The whole situation is a mess :(

    He does not need a P45 to start a new job. He will be put on emergency tax at the beginning but it will be sorted after.
    If the former employer is refusing to issue the P45 call HMRC and discuss with them or rather let your son do it as they are unlikely to talk directly to you.
    Why exactly has YOUR housing benefit been suspended? On what basis? Your household income has actually decreased. If your son wants to claim any benefits he will have to sign on and claim them. Also if he goes to sign on perhaps somebody will able to assist regarding the missing P45.
  • No, only the employer can provide this.

    HMRC could possibly supply the information from the P45 once the employer has sent the details in but they don't get a copy of the P45 itself so if housing benefit are insistent on a P45 you'll have to go back to the employer/trustee.

    Not having a P45 will not stop him applying for jobseekers allowance. He might end up on emergency tax code with the DWP but as jobseekers is usually too small an amount to pay tax on this really isn't an issue.

    I was claiming housing benefit before he started work. When he started work, I informed them and they reduced it by £35 which my son has been paying. I sent housing benefit his redundancy letter and they wanted a P45 and his April payslip, both of which he's not got. There is no payslip because they didn't pay him and fighting that out along with his redundancy pay. They've suspended the housing benefit because I haven't provided the P45 which we are struggling to get. I wouldn't mind but the centre he worked for is now closed and we have to rely on the trustee to keep checking for it. These I personally think should have been sent to the employees homes. The place has lied and lied again to the ex employers and we don't fully trust these have even been sent out. I just want to know if there is anywhere he get in touch to see if the P45 has been sent out at all and when to expect it. Because the centre is now closed, he's having to chase everything up by email. It's putting us so close to losing our housing benefit which we rely on. We just don't know what else to do :(

  • Only the company will know if the P45 has actually been issued.

    Could he not phone up HMRC and ask has one been issued? Not for another copy as I know they won't send one. Just to confirm if one is on it's way out or the centre is lying again.

  • No, HMRC will have no idea if a P45 has been issued.

    They can tell your son if they have received the details of his employment ending and he can check this himself probably on his personal tax account on gov.uk but they won't know if the P45 has actually been issued because the employer does not tell HMRC this.

    And they don't send a copy of it to HMRC.

    Number 1 - the council should accept verbal confirmation that he is no longer in work.

    Number 2 - there is no way they should have suspended your housing benefit - your sons income has reduced meaning that you would be entitled to more housing benefit.
