    OK, so you didnt remove the request for documents

    You havent understood. The defence is a documetn you write TO THE COURT.
    Your request at the end is something you write TO THE SOLICITORS of the claimant. Its why I told you to remove it.

    You didnt number each para (every carriage return is a new para, and must be numbered) so it is harder to read and reference later on.

    You must, NOW, read the newbies thread, section on Small Claims
    All of it, multiple times, until you understand EVERYTHING that you must do from now on - as there are still hoops for you to jump through.

    Despite being told, you didnt include a seciton on standing. As such asking the claimant for their contract to operate on the land may be of no use - as you cannot add to your defence unless you are VERY lucky.
  • got my reply letter. "Our client will give you the opportunity to reach an agreement and make repayments and our client will let the claim lapse" If we do not hear from u by 4pm 25th august our client will proceed and will seek judgement, Advice pls?
  • is there someone i can speak to for further help? would it benefit me to see a solicitor?

    It's your call.

    Presumably you don't want to pay them and hope to win in court should they take this to a hearing

    No, because you can't reclaim the cost.

    DO NOT pay the solicitors or contact them. Forget the idea of 'payments' for a game of soldiers!

    You've submitted a defence so you are fighting back - good. You will know what happens next, from bargepole's thread linked in the NEWBIES thread in post #2. Please don't ask how to fill in the N180 DQ...it's all there in the NEWBIES thread.

    Come back when you have a court date, well BEFORE the date by which you must submit your evidence and Witness Statement.

    If you get a court claim and want to defend it then (assuming the claimant is prepared to pay the hearing cost) you would have to attend.

  • They did not say exactly how much they will reduce it too. If I do lose in court will it be the exact amount they are saying? or will it be at a fairer rate?
