    There is no discount. It's purely designed to stop you appealing. They lose nearly every appeal that follows the tried and trusted methods here.

    They have been so unsuccessful that they cancel before POPLA make a decision. That way they avoid paying the fee POPLA charge them for hearing an appeal.

    Just do not ignore them.

    If its a bylaw case they can't do anything only the landowner can, don't even think of paying the muppets.

    Penalty notice says:
    This car park is regulate by the terms and conditions of parking displayed at the car park in accordance with Rail Byelaw 14.
    So I guess it's a byelaw case

    Don't worry that it isn't identical to your case. It's about making Indigo prove their case. They cancelled the ticket before POPLA ruled.

    Byelaw cases are a piece of cake to win at PoPLA. Indigo often infest station car parks, as do CRAPCOA, which is why I asked the question. Now you have even more ammo to see off the scammers.

    In general terms, where byelaws apply the vehicle owner (not driver or keeper, who of course are two different people) can be held liable for trespass (not a parking infringement) by the landowner which is usually Network Rail or the Train Operating Company (TOC) and only within six months of the alleged event, and only in a magistrates court.
    Byelaws mean that the land is not relevnt as far as the POFA is concerned, therefore there is no keeper liability and only the vehicle owner can be liable.

    Indigo cannot comply with any of these and would actually get nothing if it went to mags court.

    Appeal to PoPLA using all the available points that are relevant, with the word Byelaws in the title, and appeal point 1. Just make sure you down't own up :D to being the owner. It's good advice never to admit being the driver either, but in a byelaws case it is not as important.

    Also complain to the BPA that Indigo have used the word penalty thus implying they have some power or authority. This is a misrepesentation of authority and is a breach of the BPA CoP>

    Complains should also be made to your MP, Mrs May, and Andrew Jones MP. Whilst they are probably distrated by other things at the moment, you could suggest that your vote depnds on their answer.

    NO NO NO. In a Byelaws case NEVER admit to being the driver (not that you should in any other case either). If the PPC don't know the identity of the driver they are stuffed because Byelaws are in force it's not relevant land so they cannot pursue the keeper under POFA 2012. If you admit to being the driver the PPC can change tack & pursue you as the driver.
