    The payment place said I signed up online. The Gym said they have a signed copy with them. I remeber going in to sign up, at some point though I changed it from a junior memebership to a student one. So they say!

    I can't find any details of the contract at home.

    Part 1 will apply to your sons membership as it is paid for by Direct Debit
    1. Direct Debit membership – Your Direct Debit contract is with DFC (Debit Finance Collections PLC). Direct Debit memberships cannot
    be cancelled prior to the agreed contract length that you have signed
    for and the last payment has been made. A contract may be cancelled
    once the final payment has been made: this requires 30 days’ notice
    in writing to DFC (Debit Finance Collections PLC) by e-mail info@
    debitfinance.co.uk or phone DFC (Debit Finance Collections PLC)
    on 01908 422007. On commencement of your membership, any part
    month pro-rata payment must be paid at the time of joining.

    Part 3 will apply to your membership as you just paid upfront for an Annual Membership.
    3. Annual membership – These will run for a period of 12 months from the
    date of commencement. Regrettably no refunds/transfers can be given if
    you terminate your membership before the expiry date.

    Has your son been using the gym in this time at all? It does say that once a junior member reaches age it will transfer to an adult membership and he would have to sign a new agreement once his initial 12 months were up. Is it possible that he changed it to a student membership and left the direct debit details as yours? It does say that a student ID is needed to have a student account so he must have provided them with that at some point for it to become a student membership.

    Thanks for your post Fosterdog as it has prompted me to ask the Gym to send me a copy of the contract. No my son has not used it in the past 18 months.


    When they sent a copy I recalled what happened. On the 31 st Aug I took out a 12 month contract junior he couldn't use full facilities so I asked for it to be up- graded.
    On the 3 Sept a up grade form was signed. It was upgraded to a student for extra £5 per month. No one advised that a student membership wouldn't be a 12 month contract. No where does it state that it is a rolling contract on the new form.

    I am going to ring the bank and ask them if they will claim on the Direct Debit insurance.

    Did you pay upfront for the 12 month contract on the 31st August? If so, what happened to the upfront payment when you upgraded on the 3rd September?

    If you paid upfront for the year, it will be a 12 month contract like yours which does actually expire and stop you using the facilities after the 12 months.

    If it was via direct debit, it will be a minimum term of 12 months, which will carry over unless you give notice to cancel after 12 months.

    Be very cautious of the Direct Debit guarantee in this situation. If they can prove it was a rolling 12 month contract, which it sounds like if you provided direct debit details, then you will start getting letter from debt recovery companies with the potential of then going to the small claims court.
