gym membership

Hi

I have just noticed ( yes I know!!!) that I have been paying £25 per month for a gym membership that I thought ended in 2015.

I called the Leisure centre who said no you don't have a membership. Gave me number to call the company who collects the money.
Contacted them and the collect agents who said on the terms and conditions I signed it states that if I don't make contact the membership will role over. (asked to be sent a copy which they agreed to).

That the only thing they can think to do is contact the centre and explain and ask If they will let me in for free for a period of time.

Do I just need to learn a lesson and check my statements and read the small print or is there any way of getting the money back? I think if you are committing to a 12 month contract then that is what you should have not some small print being able to rob you!

    :(Don't ever sign a contract without being fully aware of the small print aka the terms and conditions.
    You could try to speak to the manager of the leisure centre, don't hold your breath though.

    Its not clear from your post, did you actually cancel with the gym or not? Just trying to work out why the gym would say you have no membership if you didn't cancel. If you cancelled with the gym but they are saying you had to cancel with the management company, that is incorrect and any term requiring such would be unfair (and therefore unenforceable).

    As for the 12 months....that is a minimum term - not a contract duration. If you don't cancel, it will put you onto a rolling 1-3 month contract depending on the terms (this should be in the T&C's they send over).

  • Call your bank - if the payments were direct debits they can reclaim the whole lot for you

    Happened to my wife, she got over a grand back and was quite happy

    I have no idea either why the Gym are saying I don't have a membership but the company who have been taking the payments say I do.
    No I never cancelled it I was signing up for 12 months so was led to believe it would no longer allow me in after that 12 months had ended.

    I asked the girl today about my membership on the telephone and she said " it ended in 2015". I said " so if I come up you wouldn't let me in?". She said "no as it has ended". Then when I explained the conversation with the payment collecting agents she said she
    would get admin to call but that hasn't happened.

    I need to go to the bank today so I will ask them for advice thank you Ringo for sharing that.

    That's where you've gone wrong. With these contracts, as already pointed out, they do not automatically cancel. They are rolling contracts. The 12 months is just the minimum term.

    Do you still have the paperwork from when you joined up?

    I would imagine that as you didn't cancel, you won't be entitled to any of the money back. If you want to use the gym, then you will have to take the proof of payment along to get them to re-activate your membership. Either that, or just cancel it down now.

    ok the Gym just called and said it is my son's account that I set up that I am paying for. We took out memeberships at the same time I think I recall that I paid mine in full and set his up on my account as a DD. Strange how the terms and conditions only apply if you have a DD set up as no one has been chasing me for payment.

    Maybe you took out a different kind of contract to your sons, considering you paid for 12 months upfront.

    Only way you will know is by digging out the contract you signed.

    At least you got to the bottom of the matter and can now cancel your sons contract if he no longer uses it.

    She said we cant refund you but ring me in an hour and I will see what I can offer you.
