Don't accept a repair because if you accept one then you lose your rights to a replacement.

    No you don't.

Not sure where you got that idea from.

Section 22 of The Consumer Rights Act tells us that the thirty day clock - during which a consumer can reject the goods as not conforming to contract - stops running, and restarts when the repair is completed.

Therefore, if the repair fails, the consumer can still reject the goods for a full refund if within that revised thirty day time limit.

Even if outside that time limit, the consumer can refuse another repair. Instead the seller must provide either a replacement or a refund.

Ok, then the law has changed. I always remember consumer experts saying not to accept a repair in the past (but I am talking 15+ years ago).

But does the above still apply if you are outside the 30 days but within the year's guarantee?

Yes. The Consumer Rights Act came into effect nearly two years ago - on 1st October 2015.

Please re-read my last paragraph above.
Also, do not confuse your statutory rights with anything offered under a guarantee.

Rather than derail this thread further, if you wish to continue this discussion, it's probably best to start a new thread on the consumer rights board. ;)

There's no logic to that whatsoever. But under the CRA you can reject it in 30 days. Formerly, the retailer could refund, repair or replace.
No free lunch, and no free laptop ;)

Just spoke to AO who then put me through to trouble shooting at the manufacturer. An engineer is coming out on monday to ensure its not user error. If its just a faulty thernostat which can be easily replace, fair enough but I dont want to be faffing about if its something which could be ongoing.

Update on this ..the Candy/Hoover engineer came out. Checked thermostat, that was ok, checked gases, all okay. Used professionally callbrated thermometers..gave the same reading as mine.
Phoned his technical manager. Concluded that even though the temperature in the fridge was at 8 degrees, there wasnt a fault. In fact, he said 'most people probably have that temp, they just dont check..' So even though not faulty, it wasnt right.
I phoned AO - they spoke to the manufacturer who looked at the report and agreed that it WAS faulty and they would exchange it for another one. There was no way I wanted another from that brand luckily I had noticed that AO had in stock an Indesit , for the same price - I would have chose this at first had it been available as all my applicances over the years have been Indesit and never had a problem.
New Indesit delivered today - running like a dream.
Great service from AO and their delivery drivers.

Glad you got it sorted. To measure the temp in a fridge put a thermometer in a glass of water & leave it in there a few hours. Take the glass out of the fridge & read the thermometer still in the water.
Tall, dark & handsome. Well two out of three ain't bad.
