Took delivery of a new Candy fridge freezer last friday 27th may. Its running at 10 degrees unless I set it on the maxium setting, then evrything in the freezer is too frozen (soft scoop ice creaam has to defrost!). Ive had three diffeent fridge thermometers in it just in case the first one was faulty.
Can I ask AO to change it?

You can, but first check that you're operating it in accordance with the instructions. It could just be a faulty thermostat which would warrant an exchange or a refund but one reason for a fridge struggling to get down to temperature is setting and clearance. Have you situated it somewhere where there isn't the recommended clearance and therefore the radiator is struggling to dissipate heat?

You have 30 days to reject it under the CRA (Consumer Rights Act). http://www.which.co.uk/consumer-rights/regulation/consumer-rights-act
    30-day right to reject

Under the Consumer Rights Act you have a legal right to reject goods that are of unsatisfactory quality, unfit for purpose or not as described, and get a full refund - as long as you do this quickly.

This right is limited to 30 days from the date you buy your product. After 30 days, you will not be legally entitled to a full refund if your item develops a fault, although some sellers may offer you an extended refund period.

As you are within that time you can exercise your right to a full refund.

What about the back and above? That's where the heat has to escape from. Many units come with spacers at the back to make sure the unit isn't pushed too close to the wall. Is it under a worktop or is it a tall unit? If the former, what's the clearance between its top and the underside of the worktop?

Or even a repair. If the 'stat is faulty, then why replace the whole thing?
No free lunch, and no free laptop ;)

Don't accept a repair because if you accept one then you lose your rights to a replacement.
