Unsuccessful POLPLA appeal!!!

Hi everyone!
Let me start from the beginning!!!
my son has swimming lessons on saturdays in the morning at the Tottenham Lesiure Center in London and when the parking in front of the Swimming pool is full we go to the one behind the premises which belongs to an Art centre and there is always space there so i park there... and as we are always in a rush i just quickly look for the location code and if i see it's confirmed we just run to the swimming lesson... now at this car park the signage is very misleading it says Pay-By -Phone and the. lots of small letter writing that we unfortunately never read and than at the bottom there is the location code!!
so i thought that i paid for my parking but it turned out i paid somewhere else due to a clashing location Code... and not using the correct application due to misleading signage of which i have photographic evidence.
anyways long story short i received 1 PCN ( but i know that i parked there one more time and i made the same mistake so i'm expecting an other PCN but i still haven't received it..)
anyways i appealed first to the car park operator and of course they refused it so i appealed to POPLA
i sent them the screen shot of the text msg that i receive every time when i use one of these parking apps ( however i never read th they are just receipts for the parking) and it shows that i intended to pay for my parking but yes when i look at the street name in the receipt is somewhere else but WHY DOES THE LOCATION CODE CLASHING? isn't there some rule that they can't clash???
unfortunately they checked the system and found that i parked there before and used the correct application of which i don't remembered .. probably my wife parked the car while we were running to swimming and she read all the little letters.. so the operating company told POPLA THAT I WAS AWARE THAT I HAD TO USE RING GO AND NOT PAYBYPHONE but it's just not true how dare they state that i was aware!! i wouldnt have risked a bloody PCN for a £1 an hour parking session!!!
operating company also submitted false sings from 2014 when POPLA asked for evidence!! i have video footage and photos of the current signs and the ring go is only mentioned in the small letter written part on each sign and only in case some one needs help they should contact Ring Go! very misleading signage!!
POPLA appeal unsuccessful and if i'm not happy with the outcome i should ask help from citizens advice bureau or from independent solicitors..
any ideas how could i win this case?:mad:

You can't - you wasted your POPLA appeal by not coming here first. All you can do now is either pay the PCN (we don't recommend this), or wait to see if the PPC issues a small claim against you.
IF they do so then you can come back here for help with creating a proper defence.0 -
which PPC was it ?
check the BMPA ZENDESK to see if they issue court claims etc
the PPC has 6 years to try an MCOL and the small claims court , if they do you need to construct a PROPER defence as mentioned above, mainly based on legal arguments0 -
Don't bother with CAB. They are useless and know nothing about beating parking scammers. Most solicitors won't have a clue and will know less than the regulars here about this unregulated scamdisctry.
Ignore everything now unless you get real court papers. Meanwhile, complain to your MP, Mrs May, and Andrew Jones MP. Suggest that your vote will depend on the outcome of their reply.I married my cousin. doesn't it count that i intended to pay for my parking but the signage is not clear! and also the Operator sent false photos of the signs to POPLA I have a copy of their documents that they sent to POPLA..0 -
a judge will decide what "counts" if or when this goes to court0

All that matters is what a judge would think and I doubt if the incorrect photographs would impress him. But there is more, a lot more, there is contract, standing, signs, lighting, timeliness, planning permissions, etc., etc., eic.You never know how far you can go until you go too far.0

thank u guys i got really scared of this crap but now i feel better!! i'm just gonna ignore it and wait for the court hearing and i have the videos and photos on my phone and the operating company's fake photos of the signage and my receipts that i intended to pay the bloody £1 for my parking but the locations code are messed up... so i'm calm!0

checked BMPA and the chance of this company will make a claim against me is less than 1 in 1000 so i feel a lot better0

And when you get your expected next PCN from the same car park and PPC please do come back here to get help on creating a winning POPLA appeal. This will mean that second PCN will be cancelled and finished with.
Also tell all your friends about this scam and this forum and make sure if they end up in the same situation they come here to get help via the Newbies Stickies and then tailored advice via their own thread before they do anything else. I did this for a friend at work recently and based on the advice they received on this forum they managed to get a retailer cancellation.0
