Buyer cites counterfeit & refusing to return

Never had this before. Last week sold an item of my partners clothing. She bought from a high street shop, we no longer have the receipt.

Buyer citing it's counterfiet and refuses to return, as doesn't want to be breaking the law in handling a counterfeit item!

It not counterfeit , but I suppose it's the 'I want a free item type thing'.

What do I do. I have offered return. Oh and I have been Neg'd already!

    AS you already have a neg then just make this as difficult for buyer as you can. Insist on a case being opened, they would then run into ebay either insisting they prove it is fake or will be expected to return it at your expense. Do nothing at all without a case.

    Incidentally, if buyer has mentioned fake in feedback at all call ebay and make a fuss, if they claim something is fake they need to prove it.

    I agreed the return case. Then not long after I got the Neg & then comments refusing to return.

    Anyway the return case active now.

    Just forget about the return. If they return the item then refund, if they don't then it will eventually just time out.


    If you call eBay in regards to the negative FB then they will remove the comment and replace it with "comment removed by eBay", but the negative will still stand, annoyingly.

    Have you supplied a returns label?

    If you have accepted the return, supplied a label and then don't receive anything back, you will be able to escalate the case to CS who will close it in your favour, the feedback will go.

    I've just had one the same and I rang just before the bank holiday, the feedback went this morning.

    I have had a couple of returns time out with no items returned. After it times out Ebay sent a message asking if the item had been returned and to escalate if not. Upton escalation it is closed as there is no tracking to prove the item was returned.

    One person who did not return had left negative feedback saying they couldn't be bothered to return. This feedback was automatically removed. In the message Ebay send when the return is closed. says that any feedback/defects will be removed automatically.

    So I would personally just leave it and hope they do not return before the return times out. If all else fails, just respond calmly and factually. If potential buyers even bother to check your feedback, a calm response should remove any concerns they have.

    Either sit tight or ring and escalate it yourself. Mine had been sat there for 30 days.

    How soon can I escalate myself as the seller?

    IME you, as the seller, should wait until the last opportunity the buyer has had to return. You should ring after 14 working days (after you agreed or the buyer requested a return) or 35 calendar days from the case being accepted.
