Product fault within warranty period - retailer in administration

Hi all,
I purchased a PC component in July 2015 from nigelohara.com and it has just failed. I am 1.8 years through the 2 year 'standard' warranty period. The manufacturer's warranty policy says:

Claims on the warranty during the primary warranty period (primary warranty period varies by region) must be processed through the seller of the product, who will forward the defective product to ZOTAC for warranty services. Warranty claims during the extended warranty period must be filed directly with ZOTAC. Graphics Cards
· Standard Warranty: 2 years
· Extended Warranty: +3years
· Total Warranty: 5 years total


Upon emailing them, Zotac stood by the above policy. As Nigel O'Hara is no longer trading, I cannot return it to them. Also, I paid through Paypal, so cannot use Section 75.


Am I right in thinking my only real option is to wait 2-3 months, say it's still broken and request an RMA then? It is pretty annoying as a replacement would be about £200 and my PC is a lot less useful without this part.

    A warranty is over and above your statutory rights so the terms they place on it are what you have to go by.


    With the retailer being in administration you have no options left. What do you think you will gain by waiting 2-3 months? The manufacturer will not and doesn't need to do anything. The rights you have are with the retailer and they died with the company.

    If (and this is what is in doubt) the OP took out an extended warranty, this runs from when the standard warranty expires.
    As the extended warranty means the OP can go directly to the manufacturer without the need to go via the retailer, this is how they will gain by waiting a few months.

    The extended warranty comes free when you register the product. I would be waiting 2-3 months because "Warranty claims during the extended warranty period must be filed directly with ZOTAC".

    Sorry, I didn't realise it needed to be said. I wouldn't have mentioned the extended warranty if it didn't apply, but I suppose the term usually refers to an optional insurance one buys to augment the warranty, like AppleCare.

    I'm merely making this post as the act of waiting 2-3 months seems weird and I wondered if I was missing something obvious.

    Other than quoting from the Zotac website, you didn't mention the extended warranty. ;)

    OP clearly states he is 1.8 years through the standard warranty.

    The missing information would have helped.

    What GPU is it? What are the symptoms? Are you sure it's broken?

    Zotac do have a good warranty service but it is a return to hong kong. Usually it takes under 28 days.

    Their warranty is 2 years, boosted to 5 years to free if the card is registered with them within 14 days of purchase.
