Cycle to work scheme

Hi just wanted some help on this matter. Sorry if it's in the wrong place

Basically I got s cycle to work scheme. However after 4 months I left employment. Now in terms and conditions it states the employer will deduct the final payment from my last pay. Anyway. 2 months after leaving I have just received a "sales invoice " from my previous company demanding £374 by the 27/05/17 " late payment will be subject to interest charges to be charged daily for each day exceeding payment terms". On the cycle to work scheme it says within 14 days of ceasing employment Yet this is 2 months after. This is the first contact I have had.

Where do I stand. Thankyou

    You have a bike that you have have not fully paid for therefore you still owe your ex employer the outstanding money.
  • I'm being threatened with interest each day. I know what I have. Their is also guidlines and rules to which they haven't stuck to. and threatening someone with interest is not a way to resolve things

    Is the amount that they are asking for a fair market price for the bike?
    If you don't want to pay, isn't it part of the scheme that you can simply hand the cycle back when you leave the employment of the company?
    If so, it might be worth considering this.

    The interest thing is a standard business clause, it's not a threat but a fact.

    As they did not take the payment from your final pay, presumably you kept the money aside, and contacted them to ask how to make payment?
  • standard. It says nothing whatsoever about being charged interest. This is why we have terms and conditions. For both parties to stick to. I haven't broke any terms They have.

    If people want to just come on and say I should just pay etc. What if I don't have the money? This could of been sorted if they followed the correct path. So why should I have to pay by a certain day and then incur charges after

    Simply breaking some terms of a contract doesn't mean that the contract is voided.
    If the contract states that you owe some money for the cycle then irrespective of your ex-employer asking for the payment later than they should, you still owe that money.

    However, if their failure to follow the terms of the contract by asking for the money later than they should have means that you will have difficulty paying now, why not explain this to them and ask for extra time or about the possibility of paying it off in interest free instalments.
    If you do so, point out to them that the reason for this is because of them not collecting the money at the time that was originally agreed.

    When the original deduction wasn't made what did you do ? Did you make any effort to pay/contact with either the lender or your employer or did you just ignore it/spend the money and hope it would go away ?

    If you speak nicely to them and stop quoting 'breach of contract' I'd have expected the interest to be waived
  • This is the first contact I've had about it. As for breaking terms. I meant in the way that I didn't just stop paying on purpose. Like I said. I'm willing to pay. Just not on their terms Or paying any interest. This is the help I need. Can they charge me interest by law
  • By the way I haven't spoke to them yet. I've only just received the letter today. And when I phone tue I will be nice lol. I always am. I just don't agree with the interest.
