Sold van on ebay
Hi all, looking for some advice. I sold a van on eBay over 2 months ago, the buyer did not come to inspect the van before the auction ended but bid and won the auction. A relative of hers came to collect the van a few days later and paid cash. 2 nights ago I received a call from the buyers father stating that she wants her money back as they have taken it to a garage and it has various issues including needing some welding done. The van had recently passed an mot before I listed it yet this person is saying these issues must have been present before they bought it.
The guy said if I don't refund they will be taking it to the small claims court to get their money back. What should I do? I'm really not in a position to be issuing a refund.

2 months? The time to inspect it and complain was the days before sale or at worst the day of sale. Private sale so buyer beware surely.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Explain it was a private sale, Caveat Emptor applies, there is no warranty or guarantee, if they wanted protection they should have gone to a dealer and you have nothing more to say in the matter.
Then go into 'ignore' mode.

The guy has just called again and told me to expect to receive papers as I sold a van that was unroadworthy. I explained that it had almost 12 months mot and he basically accused me of having a dodgy mot put on it ��....he's saying again he will pursue through the courts if I don't refund.0

Ignore, and if possible block his number, if he does get through again, just tell him you'll look forward to receiving the paperwork. Don't get into any conversation with him.

As above, wait till you receive court papers before doing anything. He could be trying to call your bluff hoping you'll cave and give him money back.
If he wanted rights which he would have got from a dealer, he should have gone to a dealer.
What was the age/mileage of the van and how much did it sell for?0 -

I didn't lie about it, I listed the stuff that didn't work properly on the auction listing. I put on the auction that it has some rust which most 2003 vans have but in my opinion the overall condition was good. Surely it should be down to the buyer to inspect and make up his own mind of the condition?

I'd say let him.
He would be being very poorly advised if he pursues this. Unfortunately there are some people out there who will be bloody minded enough to try.
You've done nothing wrong - you'd a privately owned 14 year old vehicle that you sold in good faith with almost a years MOT.
