Leaseholder parking fine
Comments
-
We have instructed the management company to hand the PPC their notice (3 months) - still vulnerable until that notice period ends. We just need to find a new PPC and negotiate proper terms that do not result in residents being fined.
It looks like the management company signed the PPC's standard terms with no negotiation or effort to safeguard residents (and I do not believe directors' approval was sought) so it's definitely something to watch out for if you're a leaseholder.0 -
I think finding the crock of gold at the end of the rainbow is more achievable! We just need to find a new PPC and negotiate proper terms that do not result in residents being fined.
The minimum you should be looking for (IMHO), is an arrangement without permits, a whitelist of residents cars, no issue of a NtK to anyone with their address from the DVLA showing residence on your estate, the immediate cancellation of any ticket issued to any resident and any issued to a confirmed visitor to a resident.
I bet there won't be many takers, because their hidden agenda is that the above cohort is their prime target.
Do please let us know if you sign up any new PPC and what their terms of engagement are. Given what you now know because of your involvement with the current lot, will put you in a much better position to negotiate hard. If you manage a satisfactory arrangement, it could provide a blueprint for others in a similar position to see just what can be done by residents who 'fight back'.
Good stuff. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I dont think the tv programme has been on yet either , due to other events
so a cautionary tale for all landholders0 -
@Fuming Parker - please do give an update on this as it is extremely relevant to a lot of other residential parking situations out there at the moment.
Absolutely, hence I am intrigued by the update if we get one from Fuming Parker - hence the bump. The tide is changing a bit though, exerting pressure on MA's is starting to bear fruit in a few locations (especially if the Freeholder is reasonable).I bet there won't be many takers, because their hidden agenda is that the above cohort is their prime target.0 -
We just need to find a new PPC
Explain why? Honestly, why?
IMHO, no site needs a PPC - and certainly NOT a residential site. There is no firm that will manage your parking.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
