I could only let them know 5 days in advance as it was the quickest I could respond.

Hi all. Just to update. I've now had my court hearing.

After 2 hours including a rather long break from the hearing (judge requested, most likely to check POFA 2012 Sch 4), the case was dismissed and no payment required. I was in fact asked if I had any costs to bring forward, which I declined as I didn't have it on me, only on an old email - but I was not bothered about this.

It was dismissed on the basis of the fact the Claimant failed on POFA 2012 Schedule 4 paragraphs 13 & 14 as they did not respect protocol for hired vehicles. I had other points considered, but it was the legislative failings which proved pivotal and the judge really pushed the claimant on this.

The Claimant was also very 'sloppy' with what evidence they submitted prior to the hearing. Additional evidence was 'accidentally' presented at the hearing; an obvious no no. Well done to G's for not submitting it beforehand, not like it would have superseded their lack of correct POFA practice.

Thanks for all the help and guidance guys.

    Any questions, please ask.

Hi all. Just to update. I've now had my court hearing.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Glad to hear you won. Well done.

    Just one query...

On 22nd Sept you told us "So the hearing has come and gone in my absence and I'm waiting to hear the outcome".

Over eleven weeks later you are telling us that you attended a hearing.

    What happened between those dates?

Oh, sorry. I informed the courts of my mistake and that I couldn’t attend. The hearing took place but it was adjourned. It would seem they wanted me to attend and defend.

    Kind of the courts?

    Bristol civil justice centre.

Is there any way of pulling up the judges records? I’ve seen similar on the Parking Prankster blog.

Thanks for confirmation, was wondering if it was the motorists' private parking graveyard in Cardiff (NGPM's main stomping ground).

IamEmanresu normally has access to who the Judge was at particular courts, but I've not seen him around these parts for a couple of weeks now.
