There will be nothing on their signage (which forms the contract) that requires payment to have been made within x minutes of entering the car park, so it was neither an overstay nor an under/failed to pay the appropriate amount as per their Parking Charge Notice accusation.

If you've already sent your initial appeal, then 'bank' this for POPLA, if necessary.

Do you have a photo of the signage? If nearby, go and get some pics.

Thanks Umkomass. Good point.I am sending my appeal now so I will include that. Although it may not matteras I received this email this morning from the Landowner:

    Hi XXXXX,

Thank you for your prompt reply.

I have requested to Parking Eye the cancelation of the PCN.

Please allow up to 14 working days to be reversed, in which case you receive any reminders please disregard them.

Parking Eye will advise once this has been completed.

    Kind regards,

    XXXXXXXX

I will of course still appeal with parking eye. Will keep you updated.

Add a final paragraph to say that the landowner has requested cancellation - and here is a copy of his email as confirmation.
