UKPC appeal rejected, big surprise!

Do you think I should pay the parking ticket UKPC issued to me in January this year? UKPC of course subsequently rejected my appeal. So, should I now go to the POPLA appeal process?
The details are as follows;
The site is a private car park for residential flats.
My plumber left his car in my numbered car parking space with a clear sign in his window saying EMERGENCY PLUMBING AT NO. NN and a telephone number.
The flat is literally 4 steps away from where the car was parked and the parking warden couldn’t even be bothered to ring the bell. I saw the warden as he was leaving the site and asked him why he didn’t bother to ring or phone and he apologised and said he’d get the ticket cancelled. Fat chance!

I took the ticket from the plumber and told him I’d deal with it, and I notified UKPC to that effect, appealed to them on the basis that as it was my space, so how could they possibly issue a fine for any inconvenience. Of course, rejected.

I had a similar situation with UKPC about 4 years ago when a friend got a ticket whilst parking in my numbered space, I did initially communicate and appeal to the first couple of Debt collectors that the fine got passed to, but after taking good advice from several websites I just ignored all communication and they eventually went away. After about 3 years!

I guess my main appeal is that no inconvenience was caused the owner of the space. Does that still apply?

Any advice is very welcome.

Pay the fine and have no hassle? Appeal to POPLA? Ignore all communication until a summons is issued?

  • You appeal to POPLA, of course. Appealing to the PPC is only done in order to extract a POPLA code, not in the hope of winning on that first appeal.

    Have you taken this up with the Managing Agents. The whole purpose of these companies is to protect residents from trespassers, not to make life difficult for them. Have you read this

    Very valiant of you, but seeing as you were neither the driver or the reg' keeper, then how can UKPC accept an appeal from yourself. Has a NTK been issued to your plumber/owner of the vehicle in question.

    Plus, would Popla accept an appeal from someone who states that they were neither the driver or the keeper of the vehicle that was involved in the contravention.

    I hope that you have kept the note informing their trained henchman that the vehicle was parked with the permission of the resident. They had the opportunity to mitigate loss by simply knocking on a nearby door or telephoning a given number, but chose to play 'hardball' and go down the litigation route.

    You really should lean very hard on the MA, trying to charge your plumber, parked on your space with your permission is an attempt to dilute your leasehold rights, possibly an offence under the Landlords and Tenants Acts.
    You never know how far you can go until you go too far.
  • Many thanks for your reply and advice. I wanted to deal with this myself to avoid the keeper/owner of the car getting involved as I told him to park in my numbered space. UKPC have only communicated with me because I was the person who raised the Appeal online.
    It might give me a problem with the Popla appeal as they ask "Are you submitting this Appeal on behalf of someone else?". As I remember I took the Parking Ticket and raised the UKPC appeal, but I seem to have mislaid the ticket.
    Do you think this will be a problem? I guess Popla will then involve the keeper of the car? Which is what I wanted to avoid.
    Any ideas?

    Ok many thanks to "The Deep". I'll contact the MA next week. Do you think it could be too late though as UKPC have now passed the fine onto Popla?

    no point contacting the PPC as this is at POPLA stage, just do the popla appeal for now
