Hi, I received a PCN through the post after overstaying a 2 hour parking 'limit' despite shopping in Morrison's at the time in question (have a bank statement proving it was 65pounds).


I feel this is unreasonable and looking through the threads on here it seems that these can be waived/cancelled.


I am still within the 14/28 day appeal period, so should I write/email to PE too to refute the charge or just let Morison's do this on my behalf? As the 14 day grace period ends next week (currently 60 pounds rising to 100pounds after this), it is likely that I will be left with 100pound fine if I have to pay. Looking at some of the more recent threads it seems that it is harder to fight these chargers - should I just pay the 60 pounds now?


I am planning on going into store tonight if I will contest it, so any advice is appreciated.

    Take that with you, that should be sufficient to get this cancelled at local level. If it doesn't, then email the following address with a copy of the statement (and any others you might have from recent previous shopping there).

    This always works.
    I have called the store and spoken to the duty manager, who has asked me to bring in a copy of my PCN and he will request it to be cancelled but I need to provide an excuse as to why I overstayed (flat tyre etc?!). Should I do this or just state that the charge is unreasonable for paying customers, or that I was also completing shopping elsewhere (the actual reason). He stated that they have one attempt to get these waived, but pointed out that the car park is not managed by Morrison's but their landlord
    I don't think you need to be making up any excuses. If he won't play ball, I'd just say that if he can't help a local customer you will escalate this to the CEO's office and let him know of his lack of help. The email should then do it.

    But don't leave this to drift too far, as you only have 28 days to appeal to PE. If, approaching the PE deadline, you have not received a M's cancellation confirmation, send the initial appeal from the NEWBIES FAQ sticky (blue text) to PE to start the ball rolling of getting this cancelled by POPLA.

    Thanks for the quick response. So you recommend I just 'appeal' direct to Morrison's in the first instance, but if I have heard nothing towards the end of the 28 days then to formally appeal to PE?


    The manager intimated that it doesn't matter that I was shopping in store as they do not own the car park but surely this will help the situation?


    I have been thinking more about what else we were doing in the area that day and I picked up a prescription for my toddler from a nearby pharmacy after rushing him to the doctors that morning, is that a good enough 'excuse'?? The manager didn't say he wouldn't help, but that a reason was needed (and shopping in store wouldn't be classed as a reason, as with no cafe etc it wouldn't be reasonable to spend over 2 hours shopping in 1 store).

    You don't need anything other than the fact that you were a genuine customer. If Mr M's emporium does not want your custom, and penalising genuine customers by using a parking company known to tell lies, both in court and out, is an obvious way of telling people they are not wanted in the shop.
    Give the manager the option of cancelling this unjust PCN, or having you and your family become ex customers.

    In any case, a complaint to the CEO normally works.

    Near where I live, the managers from any shop in a particular retail outlet can get parking lie tickets cancelled even though the stores don't own the land. It's built into the contract between the landowner, the stores, and parking lie.

    If it hasn't been cancelled in time, send the BPA template in blue from the NEWBIES thread. Copy and paste and send, and find somewhere else to shop in future.

    You should also complain to your MP, Mrs May, and Andrew Jones MP, although they may be a bit distracted at the moment.

    Thanks this is good to know, and I agree as a genuine customer surely there are interested in my custom! He did say that they don't get feedback as to if requests to cancel tickets are successful, but from what he is aware 90% usually are. Seems like it is worth a shot!

    I had a similar situation with Aldi, who also did not own the land used for their car park.

    The duty manager there said he would pass my details to his boss to get it cancelled, but he never did. However, I appealed to the parking company at the same time, with help from this forum, and am so glad I did as I would still be waiting for Aldi to cancel my pcn.

    Make sure you take a copy of the ticket so you have the details such as the reference no. etc. before giving it to Morrisons.

    As Umkomaas said, also appeal the pcn yourself it you have not received a response from Morrisons.

    I've seen 100% of complaints emailed to Morrisons get a PE PCN cancelled as long as it wasn't at court stage. Normally you get a reply in a few days from that email addy.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    So the Morrison's store manager agreed to submit a cancellation request on my behalf to PE which was sent last week.


    However, I have had no correspondence in writing from PE to confirm the ticket has been cancelled - should I chase this?


    I cannot find a phone number to speak with them, so looks like it will have to be a letter. Judging by previous threads on here, it seems like it is best to ensure this is sent by Day 28? Should I formally appeal, or just ask for confirmation that my ticket has been cancelled?

    make sure your PE online appeal as keeper goes in by day 25 , using the blue text template , adding an extra line stating that MORRISSONS have agreed to cancel the charge etc

    if PE cancel it in writing beforehand , then you are in the clear

    Visit the PE website and go as if to pay your PCN. Enter the required references. It will give you the current status of the PCN. If it's showing as still current, get your appeal underway. If it's showing 'cancelled' or 'not recognised' (or similar), you should soon receive written confirmation from PE. They are pretty efficient at doing that.

    Just tried this online and it states 'There is no amount outstanding for this Parking Charge.' Success!


    Thanks for the tip and to everyone else for the advice. Case closed - another common sense outcome!
