Offer accepted on house - but then taken to best and final offers and lost out!

    Moaning/feeling sorry for yourself will not change anything.

    I guess thats not what you want to hear.

    Estate agent has done nothing wrong, other than probably should not have got your hopes up. They are working for the seller, and the seller wants the best price.

    To cut all ties with an agent over this would be foolish, response to advice posted above.

    Thanks. I am not feeling sorry for myself at all. Infact after all they put us through i wasn't fussed in the end.
    We have got over it and booked other viewings, but the EA has really annoyed me. I hate seeing houses i like come up for sale with this specific one, especially with all the bad reviews i have heard about them!

  • Honestly I can see this from your point of view, and it is unfair. BUT, if I were selling a house and had 3 offers the same, I'd damn well be asking the agent to bargain with them all and try and get a few more £k. For the sake of a call to my estate agent I will end up with several THOUSAND pounds more. That's significant.

    I'd have also kicked myself for accepting an offer so quickly, but would accept that's simply due to my lack of experience at selling houses. Distant friendship/acquaintances or not, I'd want that money.

    So that the replies people have taken the trouble to post still make sense, here is the OP. I wish posters would not do this...

    Hi all

    So basically, we put an offer in for a house at asking price, after all viewings had taken place and offers put in - our offer was accepted over another couple who also put in asking price, as it turned out i knew the vendor so they were happy to accept ours.
    When speaking to the Eatate Agent on the phone, they informed me that my offer had been accepted, congratulated me and that the vendors had chose us over the other couple because they liked us and decided not to take it to best and final offers. At this point the EA got a bit funny because we weren't using their in house financial advisor, as they were under the impression we were, when i had already told them we had our own! They said we might risk losing it as the vendor wanted the buyer to use in house financial services (the other couple were willing to use this). I was adament i didn't want to, mostly because of the cost and i knew ours! I spoke with the vendor, and it turns out they were lying as they didn't actually care who we used to get our mortgage - so that was that!

    2 days later i get a call from the EA - "unfortunately because 2 offers were put in at the same, it has GOT TO go to best and final offers"..... but they knew about the two same offers the other day when mine was accepted!! Again i spoke with the vendor, and the EA had told them this had to happen to make it fair - i have since found out after some investigating that it has to be the vendors choice to take it to final offers, the EA cannot just tell them to do this - is this correct?
    I did tell the vendor this, but i told them i didn't want favouring or anything but just thought they should know - as not only had the EA lied about them wanting us to use their financial advisor, but now this! Everything should be the vendors choice right?

    Anyway, it went to best and final, and we lost out as the other couple put in "a considerably higher offer".

    So to be congratulated then told actually, it needs to go to final offers has certainly made me very mad. I know nothing is legally binding at this stage, but it's the fact that the EA has kind of forced the vendors to go to best and final offers, when they were happy to accept mine. I think because we are first time buyers, and they are first time sellers - they are taking advantage of us.

    I think it's just greed on the EA's side, and they should definitely not be telling vendors that it has to as if it's their policy!

    Any advice and anyone else been through this?
