Deposit Paid - price not honoured

    No paperwork my end only card with the quotations and I rang and paid over the phone. No contract or policy told instore either. Was manager who emailed this final decision

    They said
    1. I never returned
    2. Told me when they did explain policy some weeks later that ring only order when full money received now saying ring was ordered and arrived and had to return it - when I told them I was pregnant and my fingers were swollen not to order ring but now saying they did

    The ring is ordered in - its custom made thou as told me special rings are slot more expensive - secondly was told if didn't get back they would re-quote me and put money off it - which now that it's still same price - problem is I only have 8 weeks to wedding now

    No paperwork and never sent any - said they ordered ring and had to return it to suppliers and said they told me I'd loss my money if I didn't pay rest.

    You only have credit card protection (under section 75 of the Consumer Credit Act) if you can demonstrate either misrepresentation or breach of contract. My suspicion is that the shop will be able to show that they're be acting in accordance with their terms and conditions, so, even though you say you weren't made aware of these, it's unlikely on the face of it that a s75 claim would succeed.

    There may be an argument that their terms are unfair though - perhaps it would be worth discussing with your local Citizens Advice Bureau? Don't take this the wrong way but you'll need to focus only on the relevant facts, namely not being made aware of Ts & Cs and whether these are valid, rather than all the stuff about pregnancy, swollen fingers, illnesses, vouchers, etc, which aren't directly pertinent here, although being hospitalised would be a legitimate reason to have sought some additional time to complete the purchase.

    Paid £1275 for deposit in November then waited till March?

    Its a custom made ring that the shop sent back because of no show?

    I can understand where the shop is coming from, but would suggest that you really have to get a letter of complaint sent in, explaining all relevant facts and also ask for the terms and conditions.

    Also stating that you are willing? to now complete original purchase and pay the balance of £1275 might help?

    Hi yes iv said I was willing to pay the balance. They told me first that iv loss the 20 percent vat discount is balance wasn't paid so I accepted that at time.
    I got another voucher and re-prices and it was same price and I asked for deposit to be transferred over and I'd pay out standing and this is where they have got problem with - why didn't I say before I prices that of money already paid - and then they come up and said was no money - but was never mentioned before.

    I thouught it was tradition for the groom to buy the wedding ring.
