Does this mean that I now have no option other than pay? or can I maybe say claim letter was never received?
You cannot claim it was never received. You are dealing with a court here
Sorry but who is no-one ?
Surely you open your own mail
Anyway, that's why you have a CCJ which you can try
to get it set aside. Others here will assist on that0 -
Ok, thanks
No-one is my wife, who assures me she showed it to me
Have kept up to date with all correspondence, apart from the most important letter, so now have wasted a lot of money, which could have almost certainly been avoided
Obviously, got only myself to blame0 -

OK well others will be along to advise0 -
options are
1- pay now to stop the CCJ affecting your credit rating .... unless that is of no importance to you(unlikely)
2- apply for a 'set aside' .... but to do this you need to show good reason as to why you ignored , and good reason as if you would win such case.
sadly I think you are in a pickle , but please wait for further advice ...
we have a solicitors who advise here..... amongst other learned forum members

It's highly unlikely a court will grant a set aside if the court claim was sent to the correct address. If you want to find out, it will cost you £255 which you won't get back if the court refuses your set aside application (99% likelihood of a refusal would be my guess). On top of that you will still have to pay the default judgment of £275.85. Total = £530.85. That's the gamble!
If you've only just received the judgment notification, you would appear to be in time to pay the £275.85 to clear this and avoid a credit trashing CCJ for 6 years. Check what the court says about the deadline for settlement and make sure you work within it.
Looks like a very expensive experience, and a rethink on household post opening procedures!
PS - I am not one of the solicitors of which Ralph-y refers. In fact two of them have been very quiet of late. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
