Rear end collision

Hi all,

I want to keep this as short as possible.

My dad got a new car and i took it out for a drive, he gave me permission and he was a passenger.

I was driving careful through a built up area the road had speed bumps. I reduced my speed to almost a crawling pace as a parked car was parked on a speed bump, just before a concealed junction, i went over the speed bump. Once over the speed bump, a car hit me from behind, a assume she was going to fast and not paying attention.

Both cars were damaged, we exchanged details and i notified my insurance. I am insured to drive other cars on my policy but only third party. My insurance company were pretty adamant that it would be the other cars fault and were more interested in signposting me to a solicitor.

I receieved a call from the other parties solicitor, so they could here my side of the story. I told them my side. Apparaently the other party told her insurance that i came to a complete stop and thats why she hit the back of me, which is untrue.

Whats the likelyhood of her story holding up and who is liable? No witnesses and the other party was the sole occupant of the car.

    Moving or stopped means nothing, the other party went into the back of you, 100% their fault.

    even if you did come to a complete stop then it is still the other drivers fault as they ran into the back of you, you stopped and they didn't so they are the driver at fault

    Thanks all, that is exactly what i thought.

    Will this have any effect on my no claims or premium? I assume my insurer will cover all costs from the liable parties insurer.

    It won't effect your no claims but expect a rise in your premium.

    there is a very good chance that you premium will rise even though it was a non fault accident, you will need to declare the accident at renewal time and the insurance industry tend to load the premiums of people that have had non fault accidents

    if it is a cut and dried case where the other party is 100% to blame then there is a good chance your insurance company will pass you off to a accident management company to deal with the claim, or the other parties insurance company will contact you so they can manage the claim and limit there costs

    It won't effect your no claims but expect a rise in your premium.

    You are third party only so your insurer would only be involved in a claim from the third party.

    You will need to pursue her insurer yourself.

    As advised above your insurer won't be covering any of the costs of repairing your dad's car. He might want to consider using an accident management company to handle a claim against the third party


    Your NCD will only be affected if the third party makes a successful claim against you.


    You can find out what effect this will have on your future premiums now by doing dummy quotes online with and without this loss in your history

    Thanks for the information.

    I spoke to my insurer for an update today and they have notified me that my case has been passed to an accident management company.

    My dad has also been contacted by my insurer or the accident company and his car has been booked in to get repaired and a courtesy car has been arranged for him.

    I take it this is the normal procedure. The companies involved are liasing directly with my dad as he owns the car but yet its my insurance.

    Will i be liable to pay for the repairs for my dads car? My insurance have not asked me to pay any excess.
