    Yup - There is no keeper liability in Scotland or NI - England and Wales got that as part of POFA-2012. That's why things are different here - The PPC (and only the PPC, not the debt collector!) can only bring an action against the driver.

    So that's why you simply do not tell them, or be conned into telling them by answering their leading questions. :)

    Your first post identifies who was driving (to at least a forum profile). It also identifies the precise date and time of the incident. UKPC could use this info to help them a) know which specific ticket this is, and b) know who was the driver. So when you appeal the PCN they'll have all the evidence they need to know who was driving, thus throwing away a key appeal point.

    If you at least edit your OP to remove the times (change to, say, 15 mins duration), and change the date to "earlier this month", this would make their job harder.

    But it's all moot anyway ... your post has been up long enough (probably) for the internet archive (Wayback Machine) to cache the current incarnation of your post, so it's a relatively easy task to find what was originally written. :)

    Don't worry about it, this thread is already longer than most Scotland ones. No need for them, this is already covered in the NEWBIES thread - where it already tells you to ignore. Nothing has changed. Never say who was driving. Get on with your life!

    You could complain to the retailers if you don't like the silly letter chain. Get them to cancel the daft thing. And yes, the first step of complaining to landowner/retailers is already covered in 'NEWBIES PLEASE READ THESE FAQS FIRST' too, with a link to examples of hundreds/thousands of these pesky PCNs cancelled over the years.

    Once you have edited your original post, you will be safe as long as you ignore anything and everything you get from then on.

    Also the Sheriff would ask who was driving so why does it matter what this person says here ? Do you think a Sheriff will not expect an answer to this question ?! Maybe in England you'd get away with it but not in Scots law!
    If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.

    No-one here ever advises anyone to ignore court papers.

    You come across as if you are from a parking firm.

    On the one hand you protested last week that you are not connected to the VCS victim - suddenly backtracking when asked to produce copies from the case you were raving about, yet on the other hand you are fixated with ranting about it even now.

    You clearly have an interest in alarming people about PCNs in Scotland. You sound desperate. The advice here will not change as a result of that case or your ranting.

    The case that brought you here is totally different to the OP's - And if you bother to do your basic research, you will see we never tell anyone to ignore properly issued court papers, on either side of the border.

    Also, virtually all normal PPC cases in Scotland are dealt with on the small claims track, not the Sheriff Court - and if she had kept her mouth shut and not identified herself to the PPC in the first place, they couldn't even have brought the case, never mind won it!

    1. It's highly unusual for PPCs to chance court in Scotland.

    2. Sheriffs cases are very rare. Only 3 ever for parking.

    3. People are not routinely asked who the driver was in cases. Multiple cases have happened where it wasn't raised.

    You are wrong on nearly every level and are clearly panic mongering. If you want to contribute then post facts not conjecture.

    You are missing the point

    Time and time and time again, people are told NOT to ignore court papers.

    How could a sheriff ask "who is the driver", if the PPC is handcuffed
    in the first place ?
