Splashback tiles

Hi everyone, looking for a bit of guidance on how to proceed with the following:
I paid to get my kitchen walls tiled, we chose the tiles from a sample board of kitchen tiles which were sold as suitable for splashbacks.
Since getting them done we have noticed that any cooking splashes cannot be cleaned off (and we have tried everything), nor can pencil marks that were put on it to line them up when being tiled.
We have got back to the supplier and the manufacturer, who has said that he has tested the tiles and that marks do come off them, at which point we put a mark on the sample board (which we still have) and it does come off. This leads us to believe that the tiles on the sample board are not the same as the ones we were supplied with, despite looking the same.
I assume that as the tiles are not fit for the purpose for which they were sold, we are entitled to a refund but what about the workmanship?
We paid someone for a day and a halfs work to put them on, now they are going to need taken off and redone, so do we have any claim for this or are we just out of pocket for this?

What are they made from then??
Should they have been sealed?
I take it they are still not admitting liability?
Was it written down that they were suitable for splashbacks?0 -
They are ceramic tiles and no they did not need sealed (I have checked this more than once with them)
I am on my way in today to see them with a spare tile which I have marked, to show the difference and will check if it is in writing that they are suitable for splashbacks. But no they are not admitting liability as yet0 -
The mind boggles, never heard of that problem before, perhaps post a question on the diy forum ( in my home) . Could it be they were suitable for bathroom splashbacks only?0

Hi, no our tiler had never seen it before, nor the owner of the tile shop!
They were definitely kitchen tiles suitable for splashbacks. I was asking more about the consumer rights end (ie who pays to have the tiles removed and replaced) rather than the DIY aspect.

No not yet, the shop owner is contacting the manufacturer and inviting him out to see the tiles in our house. I suspect it is a faulty batch0

Nothing, just that they have contacted the manufacturer but that he hasn't got back to him0
