THANK YOU THANK YOU THANK YOU to all that have commented to help me - yet again you have been brilliant!
Email received as follows this morning - much quicker than I expected....
'Thank you for your appeal. Due to further information Topher Limited has confirmed they will no longer be pursuing the matter and the parking charge has been cancelled.'
I guess it shows that if you have sufficient evidence there are times when you can win at IAS appeal stage.
Have a wonderful Easter everyone.
I'm 100% sure that what has happened here is what I suggested could happen with irrefutable and corroborated evidence in my post #7.
Great result, nonetheless.what we have seen previously is what appears to have been a quiet word placed in the ear of the PPC by the IAS to tell them to cancel the charge to avoid the IAS judging against them. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I agree Umkomaas.
I think the IPC peruse these initial appeal submissions and weed out ones that can't be twisted against the appellant, and prod the PPC to cancel them. I wonder if this sort of thing doesn't even count as an IAS appeal on any figures.
So pleased it worked!
Ridiculous that a genuine, ordinary consumer appellant had to prove with FOUR different items of evidence that they were not at this location. But it worked!!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

And how 'independent' is that?I think the IPC peruse these appeals and weed out ones that can't be twisted against the appellant, and cancel them. Please note, we are not a legal advice forum. Whilst I'm sure IAS have read all the quotes before, I wouldn't have known to put them in, without your guidance. They must recognise on some appeals there's clearly the support being given across sites like this one and maybe that makes a difference?
It just seems a bit daft that Topher make work for everyone by refusing my appeal in the first place - but then I guess that's where some people might cave in.
Thank you all again for your assistance.0 -
There are more than plenty of PPCs who nag at their victims for years, ultimately issuing court papers (sometimes almost 6 years after the parking event) they never intend to go through with, but the individual is forced to research and draft defences and witness statements, which for 99.99% of newbies here takes hours upon hours upon hours. It just seems a bit daft that Topher make work for everyone by refusing my appeal in the first place - but then I guess that's where some people might cave in.
If they don't stand up to the bullies and defend then the court papers go through by default (with no further work necessary from the PPC) and a default judgment is served against the motorist, with a CCJ and trashing of their credit worthiness if they then don't pay up.
