Usefuk site for Phones2U Direct archive terms and conditions

Hi all,

I'm currently in the process of taking phones2udirect to court for non-payment of mine and my partners first cashback for £120 each. However, I had printed the T&C's out in Feb althouh I actually formed the contract with P2UD in Dec. Worried that the T&C's had changed, I struggled to get hold of the T&Cs that were valid at the point of purchase and then I remembered about www.archive.org which has an archive of the majority of the internet all the way back to when websites were first created.

Using this you are able to type in a website URL, go to the date in which you want to see the site as it was then and navigate as usual!

Good for a laugh to see how bad websites such as the BBC were in 1996, but definitely useful for cashback sites such as P2UD who change their T&C's at every available opportunity.

Note, only recently did they change them from:
Cashback claims are paid out in the form of a cheque, which is sent out within 45 days of receipt of a valid claim.
to
Cashback and Free Line rental promotions are processed on a strict first come first served basis; we aim to process applications within 45 days of receipt. Valid applications we be paid out in the form of a cheque.

  • Hello All , I am in a similar position , jumped through all P2U cash back condition hoops correctly and still no cash back , issued 14 day letter of intent to take court action , still no joy I am now taking court action I plan to complete on Monday , one question to any one else who has gone down the court route , this is my first cash back , should I be claiming for the full 12 months cash back as they have defaulted on there terms and conditions , due to non payment within there specified 45 day period in there terms and conditions any advice would be helpful Thanks !
  • I don't think you can claim fo the full 12 months since they could pay the other claims, it is only the first one they have not paid. However, I have read on here of people successfully claiming the full amount before the end of the period.

    They've acknowledged my claim and intend to defend it. The have 28 days....

  • Phones2uDirect new T&C's state;"Cashback and Free Line rental promotions are processed on a strict first come first served basis; we aim to process applications within 45 days of receipt."My problem is that since they only 'aim' to send your cashback payments it might be difficult to sue them to enforce the contract.We have had to sue them twice already, which I accept is part of the cashback game - I would like to continue with them for a new contract as all my paperwork, form letters, summons forms etc etc have already been produced but I would like to know if their T&C's will preclude me suing them when the time comes.I am a seasoned 'cashbacker' (4 years and 12 contracts) so I am quite happy to play the game - so long as I know it is possible to win !Any thoughts on the new T&C's from someone "in the know" would be most welcome.Thanks
  • Hi, as this thread is about P2UD and the inevitable small claims court submission, I wonder if someone could share the text (personal info removed/obscured) for a court claim that worked well for you.


    My situation is :


    * Followed the T&C's
    * Sent claims by special/recorded delivery
    * Had the first claim paid, by issuing a letter before action, to which they tried to time it so that I made the small claims court claim and paid me at the same time
    * Issued a letter before action for the second claim
    * About to send off the third and final claim
    * Reported each time to Trading Standards
    * No communication from P2UD, apart from first claim letter and cheque


    If you could share the text it would be useful to many people, as I'm sure there are other people in a similar situation.
