Form RX4?

Good Morning!

Myself and my partner are nearing the final stages of purchasing our first home. We're just awaiting completion and then we can finally move in. However there is an issue from the sellers side on the house they are purchasing. They apparently have had to raise a Form RX4 prior to completing on their end, which will then allow us to complete our end. The issue I have at the moment is that I'm currently on leave, with a slight possibility of an extra week before I have to go back to sea for a while.

Has anyone had any experience of this, and how long the RX4 Form roughly takes to process?

    Never heard of it but a quick google indicates you are asking the Land Registry to do something so it could take many weeks, even being optimistic.

    I also suspect you mean you are awaiting exchange. If you've already exchanged then you have a fixed completion date and that wont be budging without lots of hassle and cost.

    Erm, potentially. I know we've signed some contracts recently and passed them back to the solicitor. They needed witnesses etc.

    So it sounds like you've signed your contracts, but the contracts haven't been exchanged yet.

    Your solicitor can exchange contracts whilst you're away, if you want. But it sounds like that may be a few weeks away. The solicitors have to finish all the legal stuff first.

    You will get the keys on completion (which is often 2 or 4 weeks after exchange of contract).

    Completion can also happen whilst you're away if you want - but maybe you prefer for it to happen when you are around. It's up to you and the seller to agree a mutually convenient date.

    Form RX4 to withdraw a restriction from a Title.

    Timescale?

    Depends

    * what the restriction is
    * who is the beneficiary and who is applying
    * whether the form is correctly completed
    * how long the Land Registry backlog currently is
    * which LR Office is dealing with it
    * whether the applicant has informed the LR there is a related sale pending

    So, between 2 weeks and 4 months at a rough guess.

    An RX4 is used to withdraw a restriction so would be completed by the beneficiary or their conveyancer.

    Whilst our current backlog may have some impact it would not be something that should take the length of time expressed by others providing it is in order and lodged by the conveyancer. Every application is treated on merit and whilst the backlog has effected certain types of work it does not affect all, including this type so several weeks/months would not apply here.

    The current average timescale is 7 working days if all the boxes are ticked so to speak

    Delays can occur if additional checks have to be made or if the form is poorly completed so it is important to understand who is making the application and whether they have got it right

    A restriction removal has been applied for, please can you let me know how much longer this will take to process? As we are in a rush to get this removed ASAP as my mortgage offer is going to expire within the next month!

    I understand that RX4 is to be completed by the Beneficiary, in our case, The freeholder of our leasehold house. We purchased the freehold via enfranchisement 1967 and while about to transfer freehold title, the freeholder registered a restriction of disposition on the title. Now we are asked the beneficiary (freeholder) to complete RX4, it is more than 3 weeks, and after sending several letters of reminders, but still no response regarding RX4. Can the Beneficiary refuse or just ignore the request for completing RX4 form, do we have any rights? Your advise is appreciated. Thanks
