Email apparently sent, but not received!!?
Received 2 fines on consecutive days, at a train station carpark. Appealed both, one was rejected. Paid the fine. The other one I never heard back on. Since received a chasing letter for over double the amount. The debt collectors claim the client (Indigo) sent an email but never heard back from me. I never received this email. Have checked. I stated that because I paid the first one, of course if the second appeal was rejected, I would have simply paid this as well, which I would have. I have asked for proof that this email was sent
Where do I stand here? I have offered to pay the £60 fine if my appeal was rejected - but as stated above, I never received a letter saying it was or wasnt succesful (at the time I assumed because I heard nothing, that was the end of it). But I should be given the chance to pay the fine, which I dont think I have been, hence the chasing letter with an increased fine of £124.
Any advice? I am very reluctant to pay £124, but they claim an email was sent, but I didnt receive it
Many thanks
James

It's not a fine! You've been mugged into paying the first, don't get mugged again.
Read the NEWBIES FAQ sticky to show you what this scam is all about, and how you fight your ticket, then do a forum search on 'Indigo Railway' or 'Indigo Station' to learn and confirm how they've had their hands in your pocket and extracted sixty notes!

Thanks. I dont think its something I can get out of though. I mean I entered the wrong details by mistake on my ticket one morning, so in theory I didnt have a valid pass on the day for my car, as I entered the wrong registration by one digit. I appealed, it was rejected but i never received their email
So thats where I am now
Any more advice?
Thanks again

Of course you can get out of it. Read about unfair terms and conditions in consumer contracts. You made a very minor human error, why should you have to pay £100 because of it, this is a well known scam, you could mug an OAP for less.

I dont think there is an auto thing on the way in, its quite an old basic station car park. I bought a ticket, but put an incorrect reg in the app on my iphone. So when the chap comes round to check, I guess there is no ticket purchased against my exact registration
I sort of accept that was my fault. But my point on this thread is I appealed, heard nothing and now its gone from £60 to £170. They claim an email was sent 2 months ago, but I never received this0 -
If this is on railway land byelaws probably apply. Stop apologising and inform yourself, read this

Who was the parking company? You never know how far you can go until you go too far.0 -
OK, so, a couple of points.
(i) if the outstanding ticket is in connection with parking that you have already paid for, the parking company is able to check that. They simply take the last few digits of your card and cross-reference it with the date of the parking. You should not pay a fine.
(ii) the terms of parking almost certainly stipulate a requirement to pay, not to pay and provide the last few digits of your registration number. If that follows, transposing some digits is actually irrelevant.
(iii) If there was a rejection of your appeal this, strictly speaking, should have been notified to you in writing not by email. Email is not an address for service of proceedings unless you specifically consent to such.
(iv) the Claimant should be looking to resolve the issue without escalating to Court. They have incurred no loss. A vehicle was parked and paid for.
Thus I would be writing asking them to discontinue pursuit of your case. If they persist they are unlikely to succeed given that you have paid. Any escalating costs referred to will not be recovered because you will have made clear that you did pay and it is entirely within their control to check that.0 -
Thanks guys this is great advice. Its all a bit scary as you read about these sort of things being escalated and suddenly you owe £1000 or something when you could have just paid £60
Just to be clear. I had 2 fines on 2 consecutive days. Appealed both. First one got rejected, so I paid the £60. The operator actually took that payment, and paid the 'other' one by mistake. The first one, from their point of view was never paid, so they send me this letter saying there has been no payment, its now £124. I call up, explain, they put the account on hold saying they will be in touch. No more contact, then suddenly a letter today from debt collectors, after £170. I call up, they admit its a mistake, and can 'roll the fee' back to £124.
They claim (news to me as of today) that an email was sent to me 2 months ago saying my second appeal had been rejected, which I did not receive. The detail of that claim was as I wrote above - bought and paid for a daily ticket, got a receipt. Accidentally put one digit incorrectly in for the registration. I thought I would be pardoned in this case as I clearly paid, they incurred no loss, and I had proof of receipt.0 -
So just to add - the fine they are chasing me for, I have already paid- or at least I called up, quoted the reference on the ticket, and paid. They took payment for something else. So at the very least, if both have been rejected, I should be charged the basic £60 per ticket?0
