Smart parking ,DRP charge, SHOCK

Hi, today i had a demand for payment - unpaid PCN £160 from DRP .Came as a shock , saying that they are writing on behalf of Smart Parking. Unknown to me ,they sent the first letter to my previous address, (as i just moved house and not yet informed the DVLA) but it wasnt passed on , so the charge is now in the hands of DRP. Of course i dispute this decision , and have asked them for proof of the said incident, but they said that any proof will be sent straight to the courts. Can they do this ?? Really worried , am going for a mortgage soon worried about CCJ , NOT SURE WHAT TO DO NEXT, thanks, Em

You must treat DRP as complete idiots for saying that and indeed any other waffle they come up with .....

    DRP ARE POWERLESS

Ignore them. all they can do is pass it back to Smart.

Smart are not lovers of the court system. If you get a Letter Before Claim then come back here. In the meantime ignore DRP and NEVER contact them

Have read the thread , but it informs people how to go on about appeals, where as a WATCHDOG episode on youtube shows a solicitor saying these charges are unenforcible and throw the letters away. Not sure wether to do this , but the DRP say they wont send me any proof of the incident , should i even be speaking to them , or should i be speaking to Smart Parking . Thanks Emma

That Watchdog video is totally out of date and to be ignored.

Re your new address, you must advise Smart of your new address just in case.
You write as the keeper (not driver)

Send it by ist class post and get a free posting receipt.
    Ask them to confirm

Ensure no phone number is given.

Reason is that if they do go to court and details are sent to your old address, you will never know and that is how they can get a default win resulting in a CCJ

As said, ignore DRP and just relax and wait, probably will never happen

Just block DRP on your phone .... end of

All DRP letters go to the loo, only place for them.

PS: There will not be any door knockers

Have you now informed the DVLA of your change of address? They provide real shocks, with real fines, up to £1,000!

2 x notifications; one for driver licence, one for V5C.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
