    I suspect you have only explained the circumstances to your insurers over the phone. All they are really interested in at this stage is a basic, who is at fault and how do we sort out the vehicle repairs?
    Even if you gave them War and Peace over the phone, the advisor will have summarised this in one or two sentances. On yours this would be something like "TP (third party) hit insd (insured) in rear".

    By explaining about the full circumstances now, including the earlier incident, you are only expanding upon your initial statement. You are not changing it so nothing to worry about.
    Put it in writing though and email it and post it to the insurers. You need to be certain that their actions do not prejudice your claim.

    Did the police speak to the other driver. Did you hear anything that was said? All adds weight if your solicitor / insurers can say to the other persons ins co that their driver had to be warned by the police to calm down and explain his stupid actions.

    I just spoke to my solicitors, he had made a claim against me and said it was road rage :eek:
    What a bloody cheek, the police did tell me they would have a word with him about his behaviour, i'm unsure if that is noted, although i think i may be able to request a copy of the incident report.
    I have got to write it all down in full, and apparently it might end up that it's a criminal case or something :confused:
    So now i have to write down the whole version of events and sent photos of damage, then the solicitor will decide what course of action she can take.
    I'm well peed off, i dont care if i get no money but i'll be screwing if they say i'm at fault.

    You need to give a full account of the circumstances, in writing, to your insurers and your solicitors to ensure they are fully aware of the background. The earlier incident will not weigh against you.

    Did the police actually attend or did the phone operator just note that you did not feel safe and leave you to fend for yourself? If so, that is terrible and I would be making a complaint.

    There will be very little, if any, evidence to support the fact that the OP's towbar caused the dent in the angry driver's car. It could have been caused by any one of thousands of cars with towbars - he'll claim someone reversed into his car at Asda car park or some other story.

    I don't think the dent makes the slightest bit of difference to this case - if the police didn't note it at the time and no one mentioned it, it would be just as easy for the OP to claim the dent was caused by the towbar as it would be for the angry driver to deny it.

    Basically, it's irrelevant now.

    Have you got legal advice or asked at the citizens advice bureau. Another thing, I know that the country roads are 60mph limits but that doesnt mean you have to go that speed, on country roads you should be aware of concealed entrances and different hazards and be prepared for them. I live in the countryside and have seen the consequences of accidents from people going too fast

    If you went into his side did you not see him approaching the road?

    My point was that the other party had no intention of causing an accident. They made a mistake. So it's rather unsympathetic to say
    "he had a fractured pelvis but i dont know or care.".

    Do not be in a rush to settle.
    Sometimes there is a delay before you find out the long-term issues from your accident.
    If you settle now then in 2 years' time need further surgery to correct something ... you can't go back and have a second bite.

    This is why compensation takes so long and people can wait years.

    so is answering for other people. AM apologised, it's not up to you to decided whether or not to accept that apology as it wasn't aimed at you.

    You aren't the OP, if the OP has a problem with someone asking a question on a thread they started it is up to them to mention it, not you. It's an open discussion board and anyone has the right to post on any thread as long as what they post isn't against the board rules.

    (sorry to the OP for "butting in" but I'm getting really fed up with some posters coming out as self appointed board police)
