Ppi error lead to bankruptcy-need advice

    If I summarise the op claims they were told verbally they were due a £17k PPI payment which materialised as a £7k payment and an expectation that £10k had paid off the card

    Subsequent letters/contact was presumably ignored leading to the account being passed to DCA and the bill increasing exponentially whilst the Mr OP blew the £7k in 3 months spending

    Barclays take no responsibility, Ombudsman has found no fault but someone must be to blame :mad:

    No it was court fee and the legal costs of the bankruptcy company that took it to 50k. There was no credit card bills to be paid as the balance was supposed to be cleared with Barclays share of the ppi, Barclays had told us before ppi payment. Yes the money he got £7k was spent over three months. Over that 3 "months Barclays sold the debt to Lowell whilst we heard nothing. We still were not aware Barclays hadn't taken there money first as they had said they would until he received a statutory demand for bankruptcy.

    Bankruptcy does not cost £40K+ in costs and legal fees.

    If the card balance had been paid off you would have received a bank statement confirming the payment.

    Something here does not add up.
  • No sorry mate your wrong. There was no statements or bills sent as they had apparently sold it on long before, but heard nothing from them. The Ombudsman has awarded £250 for the error but it doesn't touch it, get your facts Right😀

    I asked above if the debt had already been sold on and you said no. Which is it?

    If it had already been sold on then you owed money to Lowells, not Barclays. Did Barclays say they would recall debts sold to third parties and pay them off?

    Sorry but you are not making any sense. There are huge chunks of the story missing. From what you are saying, your partner didn't bother to check his account as he thought (incorrectly) the balance was settled and account closed..... his mistake.


    He may have got a refund on PPI, but why would you think that means he is not liable for the actual balance he had spent over x amount of years. If you spend on credit cards you have to pay it back.

  • Yes I agree but Barclays sent a letter telling him they would clear it first. He didn't just assume they would.
  • Yes they sold it at the time of the refund but he received nothing notifying him until 3 months later, Barclays have admitted their error.

    What exact error have they admitted ? And what exactly did the Ombudsman reject ?

    £250 on an apparently consequential £50k loss doesn't sound like they did that much wrong

    They sold his debt when he recieved the redress?
    That doesn't make sense.

  • The error admitted was Barclays telling him they would always clear the outstanding balance before him getting his ppi refund and not notifying him they hadn't when paying him. The £250 offer was from the Ombudsman for this.
