Accident: whose fault is it?

In a short.. he was just behind me until he saw the signal turn green. There were few vehicles in my lane. As soon signal turned green he pulled from the right and sped up, but started to indicate in front of me.. I gave him space to join my lane but he kept pushing me out of my lane.. apparently he was going all the way to the left changing 3 lanes. There was no car behind him which could have prevented him to stop and let me pass.

He refused to give his address and insurance details, the only thing stopped him driving off was police cars attending another incident just yards from our accident.

So my question is, whose fault is it?

    Although the other driver was in the wrong by being in the wrong lane and trying to push in, it does look like at the end he is still in his lane and you were over...

    As for not getting insurance details, isn't a number plate enough? It was when I made a claim a year or so ago.

    I have to say the dash cam doesn't match your description. It looks like you accelerate to block him cutting in rather than leave him the space you claim. You can also see him indicating and come across him. You might get 50/50 with insurance though because the guy is in the wrong lane and does try to cut across the front of you.

    The other driver is clearly at fault. He's in the wrong lane, he has to cut across you to get to where he wants to be, the onus is on him NOT you. His impatience and bad driving caused the accident.

    You can clearly see he is there indicating to get into your lane and there was plenty of room for him to do so, why didn't you ease up a bit to let him?

    Whoever is in the wrong could have so easily been avoided, was the extra couple of seconds you hoped to gain on your journey by not letting him in worth the hassle you now have to sort out with the insurance claim?

    It doesn't really matter what everyone on here thinks, its the insurance company that will decide, its good you have the footage so at least you know whatever the decision it is based on fact not 'he says. she says'

    Are you kidding? The OP clearly wanders out of their lane hitting the other car. The other driver may have been in the wrong lane, but he / she does not try and force their way into the OPs lane.

    We have all been in the wrong lane from time to time, and if the OP had just held back to let the other driver get to their correct lane their would have been no accident, but they seemed determined not to let that happen, and compounded that with a touch of careless driving.

    I know I could have let him cut me across all the way to the left. I personally hate impatient drivers who don't queue up but force theirself in right at the junction.

    Question was who is legally wrong not morally. I have another footage where he did accepted his mistake.

    Although you have footage to prove this, roadside admissions of liability by the driver count for little if their insurer disagrees!

    at the tine of the crash, whos car was over 2 lanes?

    it seems to me that he is entirely in his lane, and you have crossed over the red hatched area and are in 2 lanes.

    You are trying to get behind the white car, both you and him were in the wrong lane, but you moved first.

    he might have been indicating to cut you up, but you DID cross over the lanes and hit him.
