I don't know if they can object so mthats why I asked the question, thanks for the answer
I'm not eligible for a DRO because I own my own home[/QUOTE]
I spoke to SC today about my changes (namely that I cannot calculate my correct mileage), they were lovely. Though the course of conversation the lady at SC told me to call back when I got another job with reduced income, or any income changes.
Call them and explain.

Just for information purposes, and for the avoidance of any doubt, if your circumstances change, for whatever reason, and this results in lower payments, then so be it.
No one will be canceling your arrangement, its an informal agreement you have, which means if things change, so can your payments, DMP`s are very flexible, and so are the charities that run them.

Hi all,
After me sending complaint letters,a few phone calls the Halifax (don't phone just write lesson learned) I got a letter last month saying my depts going in to the recovery team and just got a letter saying its in default and finally they have stopped interest just got to wait for the finale demand letter and then hopefully they will sell it on,one thing did scare me a bit was the default letter saying they might start court proceedings to recover the money I am really hoping the don't go down that route does anyone think they will? Been with SC for 14 months and Halifax have been the worst to deal with cheers0 -

Firstly - it won't go to court. There are many stages the account would have to go through before it ever reached that point and that would only be triggered if you stopped paying them anything for a long time and without a good reason for doing so.
The default letters always use language such as court proceedings might blah blah... they are written in that way to worry people, that's all. Halifax don't actually 'sell on' their debts, they'll pass it to a debt collection agency which I believe is 'Wescott', to handle collection on their behalf.
My Hfx debt was sold to them, back in the days when Hfx did actually sell them on - but all that happened is I received a letter from Wescott giving me the new account details for payment (reference numbers etc) and I just updated the payment instruction via SCs online portal. It stayed with them until it was settled and they were very easy to deal with, just sending statements out from time to time.0 -

Hi,
Standard legal wording, they might start court proceedings, I might win the lotto tonight, but i doubt it.
Its normally the wont pay, as a pose to the cant pay, that have legal action taken against them, but then not always, most of the time, creditors cannot be bothered to deal with bad debts, and just farm them out to DCA `s such as wescot etc.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Good morning all
Thought it was time for a bit of an update on my current situation.
Having finally gotten around to scanning in the tons of paper LINK sent in response to the CCA requests (x3)., I sent them off to the great folks on the AAD forum and, as I suspected, they've come back as enforceable. But rather than be downhearted -- at least I know for sure where I stand on these ones and can focus on getting rid. Time for some F&Fs methinks, so I'm going to do a bit of research on the F&F thread and see how well (or not) people get on with F&Fs to LINK.
Whether they are happy to play ball or not is inconsequential really -because if not then I'm just going to pay a monthly amount I'm happy with. I'm no longer desperate to pay off everything as quickly as possible and happy to take the long road. The accounts will drop off the file in 2020 (less that 2 years from now) so I'm in no particular rush to clear them.
Hope everyone else is chugging along nicely with their DMPs and for any new starters - don't be afraid to hold your ground with creditors and DCAs. It's only money after all0 -
Thanks for the update, Suseka:T. Well done on getting the info over to AAD (the scanning does take such a lot of time, doesn't it, especially when some of the CCA requests result in huge packages of seemingly unrelated paperwork:eek:). The amount of stuff that came back from Lloyds put me off dealing with that one for months:o.
Can I ask how you long you had to wait for a response from AAD please? Did you send scans for the 3 individual debts at intervals or pretty much straight after one another?
I'm really sorry your LINK ones are still enforceable but at least you know where you stand now and can plan your campaign accordingly. I know exactly what you mean about the remaining time frame and your plan to take a more leisurely route:T. Most of mine drop off my file by mid 2019 so by this time next year I'll have a largely squeaky clean file;). All except the dreaded Lloyds that is who were very late to default and don't seem to want to play ball by backdating it:mad:
I have 2 debts with LINK, both old MBNA credit cards from around 2001, strangely one UE and one which sadly is enforceable. LINK are very easy to deal with IMO, although not the quickest to respond to letters:( but I haven't actually tried them with a F&F offer yet. They've never given me any hassle though. I was considering doing a F&F in September as I've been paying the enforceable debt (with an outstanding balance of £3700ish) at a rate of £1 for a year now. I'll keep you posted.
Good luck:beer:0 -

Hi Suseka
Sorry to hear about the confirmation of the enforceable debts - hey ho - we can't win them all
I just wanted to say I love the bit of your post where you say you are going to pay a monthly amount you are happy with and are no longer desperate to pay everything off as quickly as possible. This so describes the mindset I now haveI am very happy with being in control of my debts and my DMP rather than my debts controlling me and even worse, creditors/DCAs controlling me.
I'm chugging along nicely as well. Technically my debt free date now is 2044 based on the rate I am paying now :rotfl: I don't actually think about that because I know it will be much, much sooner than that in this game of strategy that we play with the DCAs.
I love to read your posts and keep up with your progress - keep up the great work on slaying down those debts at the least possible cost to you :beer:DFW Nerd No. 1484 LBM 07/01/15 Debt was £95k  Now debt free and happy :j0
