Daft question time again.
I have just had the following letter from co-op.
DEFAULT NOTICE served under section 87(1) of the consumer credit act 1974.
But then goes on to say the usual garbage about paying arrears etc or the full balance will become payable or further action may be taken against me.
It also says this letter should include a copy of the current FCA sheet on default, it doesn't actually say I've been defaulted. Am I just being stupid again or is this just another blah blah blah letters?:doh:

Had to pop out for an hour and in the meantime I had a phone call from Link which OH answered. They want me to phone them back as a matter of urgency before close of business tonight. He asked if they could tell him who was calling and they said it was Link but thankfully when he asked if they could tell him what it was in connection with they refused to say. Thank goodness for that as OH knows absolutely nothing about my debts and I've been living on my nerves for years ensuring he never finds out:o. He hasn't a clue who Link are.
I asked them weeks ago to only contact me by letter and I admit to not responding to the request for an updated I&E but other than that I haven't done anything to cause them any anxiety. They've never phoned me before. I'm a bit scared to phone back to be honest although I have no idea why. I just can't imagine what they feel is so urgent but I expect it's just the scary tactics they employ:eek:
They hold 2 of my bigger debts (£5000ish and £4000ish) one of which they told me weeks ago was unenforceable.Don't put menthol vape juice in your eyes!!!0 -
Not a daft question!
It means the account will be defaulted Vaper and is required in the CCA section quoted in order to do so.
However yes, if by some means you paid the debt or the arrears in the timescale quoted, the account would not be defaulted. As you're not going to, it'll go to their collections department and be marked as a default, eventually!

So much for writing only eh Link? Imbeciles the lot of them.
Phone them up, get to the right department and say the following, before they get to say a word:
"Hello, My Name is Carbootcrazy and this call is in regards to an account x being dealt with by yourselves.
In regards to your recent phone call asking me to call "urgently", I wish to draw your attention to the fact that I have requested all contact in writing only. Your call has caused significant distress and I request again, that if you have any need for correspondence, that you send it in writing only. I will not be discussing my account over the phone under any circumstances. Your number will be blocked from my phone once this call is terminated. Thank you."
Then hang up. Do not let them get a word in edgeways.
They'll take the hint.

That's exactly what I meant
These guys work by eliciting fear from debtors in order to get them to pay.
Stand your ground and tell them to stick to the terms that you've stated. Legally they can't take any action by phone, so why bother. If it's important, then put it in writing. Otherwise, they can take their bully-boy tactics and shove it up their proverbial.
