Good advice from a landlord, this will get you emergency accommodation, but a CCJ on your credit file, nil chance of credit, your name on one of these bad tenants lists and no chance of renting again?? Oh dear:(

A CCJ isn't a given. A landlord being granted an eviction order and engaging bailiffs does not lead to a CCJ. Not paying the court costs could lead to a CCJ though.

Since a tenant doesn't get a CCJ just for being evicted it will not be recorded anywhere on their credit files. As an aside, people with CCJs still have access to credit. Some can even get mortgages.

What's this "bad tenants list?" Is it like the credit black list that doesn't exist either?

I think that is what is going to need to happen unfortunately, Its not ideal and I hate to be akward with LL but seems I have no option, The housing officer I spoke to today was quite abrupt saying well you'll have to find alternative private rent sorry but its not possible. I will email LL tomorrow and explain that this is the situation just so we are all prepared.

I've spoken to my propective employer and explained the situation so my application has been put on hold, if I start then am not in the area and unable to attend the claus in the contract means I would have to pay them back money for training etc plus I will have burnt that bridge. I have been ill and spoke to ESA but have been told I'm unlikely to get help from them so I've had to make an application for JSA for the first time in my life just till I know where I'm going to be. I think this will help me not be forced into private rent as they are unlikely to accept someone on benefits, the whole system is wrong.
  • You should consider renting a cheaper 1 bed place just while you start your job, focus on your health and start saving for a move somewhere bigger. It's not the end of the world to sleep on a sofa bed for a year or so.

It's also not the end of the world to move a child from school or nursery; people have to do it all the time for job/financial reasons. If your wages can't cover local rent it's not a sensible area to live in.

Having a child does not mean that you automatically get accepted onto the Housing Register in my LA. It used to be enough; now it is not. Applicants are helped to find another private rental. Also, we are moving people into high rise towers that are going to be redeveloped in a few years to ease the temporary accommodation burden. They're really not nice places to live and the tenants will have to move again once we need vacant possession.

I think the point the OP is missing is that even if her LA accepts that they have a duty to house her, she could be in expensive temporary accommodation for years.

I don't think people realise how hard it has become to get a secure social housing home

I think you are generalising based upon an inner city location.

That said, the LA have a duty to house the child, and 99/100 its cheaper to house a family than to take a child into care.....

I'll wait as long as needs be, It was the governments fault for selling off social housing in the first place plenty of people have made a nice profit from it, morally wrong social housing should never be sold it defeats the purpose now look at what state we're in, astronomical rents, LL buying up properties.

OP as a LL I gave notice to one of my tenants. She wanted rehousing through the council and I understand that but the process we HAD to go through was:

I submit s21, this must be completed correctly and given at the correct time or it is not legal

Your LL must have secured your deposit or they cannot evict you!

Two month notice expires and tenant remains in property.

I submit papers plays £380 to the court, they produce a court date about a month later could be longer.

We all go to court, as tenant you must attend.

Court gives me the LL possession but only if everything filed legally and correctly.

Possession can be any thing from 2 to 6 weeks after the court date depending on circumstances.

Tenant continues to remain in the property

Ll pays £120 to bailiff who sets a date and informs tenant of that date when he will be taking possession.

For most Councils it is only after the bailiffs eviction that you have become homeless, if you leave before that time you have made yourself homeless.

You must pay rent during this time otherwise they will say you have made yourself homeless.

As you can tell it is not a quick process. Do not just leave the property or you will not get any help.

You may want to explain this all to your LL, they may buy you out.

What a mess to get a tenant out!!!! Even for the tenant does not sound like a walk in the park either, how did it get to this point?
