Yes. If you did not make it up then point to where in the thread the op stated that Nintendo had said tamper seals were broken.
Or did Nintendo simply refuse to divulge how they knew the machine had been tampered?
Neither of us knows the answer to that question, which contains assumptions that may not even be true.
What we do know is Nintendo did not say tamper seals had been broken which you quite wrongly said was a fact.
as we haven't had it modified by anybody I phoned Nintendo to find out what exactly they meant. unfortunately they were particularly unhelpful and "weren't at liberty to explain further".
As you deny doing anything other than removing the card I would expect them to explain further and provide evidence. If they cannot do that they should repair it.
Try searching Nintendo forums for similar problems.
I wonder if a flashcard was used in the nintendo DS as I understand that these may make the device unworkable "bricked" as it could trigger the built in anti-piracy software. If that was the case then the ds would be considered modified and the warranty void.
OP, I wonder if maybe a friend of your son's shared games that were on a flash card, rather than the original nds game cards and this caused the machine to "brick"? Just a thought.
