nintendo wont repair under guarantee

It is described in the user's documentation, and is featured on that Nintendo webpage I linked to earlier.
If the OP hasn't accidentally broken such tamper seals, then I am at a loss to explain why Nintendo have refused to repair or replace.0 -

Nintendo are not stupid, they know it's been tampered with and not just to remove the SD card.0 -
I'd be inclined to take it back to Tesco and let them sort it out, you'll need to speak to the store manager who'll have more discretion to help.0

If the machine was opened you may have invalidated the manufacturer's warranty.
But that doesn't matter. Under the Consumer Rights Act, Tesco are responsible for ensuring that your product is 'satisfactory quality' and 'fit for purpose'. A machine which doesn't turn on after a month clearly fails that test.
You need to demand a refund from Tesco as the retailer. If you don't get anywhere with the shop, put in a formal written request for a refund to Tesco via email or a letter.0 -
How old is your son? Is there any chance he could have tried to hard mod it and messed it up? I doubt Nintendo would class the screws to access the battery and SD card as being tampered with, it is more likely there was further evidence of tampering somewhere.0

Those saying go back to Tesco are ignoring the fact that Nintendo say the tamper seals have been broken. I gave the OP the benefit of the doubt by suggesting this may have been done accidentally, but if (as others have said) this is not possible then there is only one other conclusion to make...0

Bit if Nintendo provided instructions as to how to take the back off to remove the SD card, then following their instructions shouldn't invalidate the warranty.
To the OP: was the game bought on a credit card? If so, then you have another line of attack: go to the credit card supplier and tell them you wish to make a claim under Section 75 of the Consumer Credit Act. That way, you claim off the credit card company, rather than Tesco.If it sticks, force it.
If it breaks, well it wasn't working right anyway.0 -

I think warranty and statutory rights are being mixed up in this thread. Bear in mind the issue with the warranty potentially being void is a separate issue to OP's statutory rights (Consumer Rights Act 2015).
First and foremost if something goes wrong within the first 6 months of purchase it's the retailers responsibility to repair or replace and it's also the retailer's responsibility to prove deliberate damage if any is alleged. They only have one chance to repair then the OP can request their money back.
How the retailer attempts the repair is not the OP's concern. It's not the OP's concern that Nintendo are refusing to repair, it's the retailer's concern. Otherwise manufacturer and retailer could just pass the buck between each other indefinitely.
If the retailer is not accepting responsibility/fulfilling their obligations under the law then it's just a case of escalating it within the retailer to a higher level.0 -

Having said that, Samsung refused to repair my phone saying I'd modified it - I'd done no such thing, I can only think I triggered the Knox flag trying to get it out of its infinite reboot loop0 -
