Issue with new car purchase

Hi Guys and Girls
Bought a BMW 1 series 6 weeks ago from a dealer, bit gutted as traded in my 100% reliable car for this and have had nothing but problems with it!
Firstly I had an issue with drivers side window switch not working (took them a week to sort that out and I was without a car).
Secondly once a week its throwing out loads of smoke to the point it looks like my car is on the verge of blowing up lol. Ive done some research and from the codes etc it looks as if the car has been remapped (chipped) and done badly hence the errors.
Ive got car booked in with BMW tomorrow to look at to see if they can flash the ecu back to the pre-map state but they arent sure whether they can do, they did say it may need a new ECU £££££.
Im pretty sure that the garage I bought from wont want to pay for that to be sorted and nor do I want to trek all the way over to Bristol (1 hr away) to give them the car to fix (would be done cheaply) so my plan was to maybe pay to get it fixed myself and then use Chargeback and claim from Mastercard (I paid £250 of the deposit on Credit card).
So my questions are: 1. can I bypass the garage altogether and just claim back from Mastercard or am I better approaching the garage (who I know wont pay).
Any help much appreciated!

Maybe get it mapped properly - theres a mobile company called E-Maps, very and recommended on the BMW forums. He mapped my E91 320d and it was 100% for the 50,000 miles I put on it, made a huge improvement.
You will probably find that its not the map but maybe the DPF if its got one, or thermostat issue - is it a diesel? Can you find the hidden menu and see how hot the coolant is after a few miles of normal driving?0 -
The codes that are coming up are to do with Torque limits (3 of them) Ive checked the dpf and I only have around 7g of soot and under 30g of ash. Im getting no dpf warning lights but I do get a dpf code come up every 3 days after clearing it.
Yes it is a diesel, other thing forgot to mention is the engine number from ecu doesnt match the vin for lights or ignition which either means engine is different or more likely the ecu isnt, which to be honest could be causing the issues.
How would I claim a remap back as well? technically its altering the car so pretty sure I cant do that?0 -
You shouldn't be spending any money on it, or taking it anywhere that the garage you purchased it from hasn't authorised. You shouldn't be bypassing them, and shouldn't be using chargeback at this stage. You should be taking it back to them for it to be repaired, and if it's a decent garage, I'd be expecting a courtesy car while they have it.
Being 1 hour away from you is totally irrelevant to any claim - if you're not prepared to travel that distance in the case of problems, you shouldn't buy from that distance away.0 -

In that case take it back for a refund - sounds like its an engine or ECU change and this is the cause of the issues which will never end.

Thanks, can I take it back after 6 weeks? am I better off getting the result from BMW tomorrow and then approaching them to say pay to fix or give me a full refund?
I actually suspect it may need a new ECU & DPF and if that is indeed the case we must be looking at £2k at least!0 -

Well you've miss-titled the thread then as it isn't a 'new' car then which makes all the difference.
However, you should still give the seller the opportunity to inspect and rectify the issues. You may prejudice any claim that you may have should you allow somewhere else to carry out any work unless the seller agrees to authorise it. The fact that you bought the car from a dealer some distance away is unfortunately irrelevant.PLEASE NOTEMy advice should be used as guidance only.
