How long does a land transfer take?

It came to light (on the day of exchange!!) that our back boundary is not registered correctly with the Land Registry and a portion of land that is ours, is registered to a church behind us. They are quite happy to transfer the land as it's obviously a mistake (our house is much older than the church and it's quite obvious where the boundary should be) and our solicitor has submitted the TR1 form to register it to us.

My question is, does anyone have any experience in how long the transfer of land is likely to take? Our buyers are unable to exchange until the transfer is complete (as they are unable to get the mortgage otherwise) and if this takes more than a few weeks we are likely to lose the house we want to buy... :(

    Depends on various factors eg

    * workload at the Land Registry- currently they have backlogs, but you can ask them to 'expadite' the transfer as a sale dependson it

    * whether the transfer is contested.If as you say, when the LR contact the church, the church responds immediately, and without contesting the transfer, that will keep things moving.However the church is not renowned for speedy response, often having to forward matters to committees for review etc

    * whether the existing and replacement Plans are clear. may depend on a survey either by the transferee, transferror, or land Registry

    We go to the church and personally know the trustees, so they are aware/ very happy about the transfer.

    I think the plans are very clear and the LR have been told it's urgent.

    What does the land in question comprise? If the (unlikely) worst case scenario is that your buyers don't get title to, say, an overgrown bit at the bottom of your garden, can't they take a view on it?

    You say it's a TR1 but it's a portion of land so it's important to know if it's a Transfer of whole (TR1) or a Transfer of Part (TP1)

    If the former and in order the average timescale is around 7 working days.
    I suspect though that it's the latter as you have posed the Q. If so then the average is around 63 working days. All averages though.

    As posted already the applying solicitor can send us details of the confirmed sale/purchase and a request for expedition. If accepted that can reduce the delay significantly to a few weeks. But the key remains that it is in order and can be registered.

    It is indeed TR1 and we have had it confirmed today that it has been expedited... and will take "up to 10 working days" .... so fingers crossed our buyers will hurry up and exchange, so we don't lose the house that we want!
