Don't forget as well that small claims is going to cost you , so consider that before proceeding. OP... don't jump the gun with the small claims stuff.
Try a strongly-worded, legal-sounding letter, sent by recorded delivery.
Insist they supply goods, or refund you, or you will be taking it further.
Worth a try!My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I opened a dispute last week, and got this reply this evening;
''Hello apologies for not getting back to you sooner. I am still waiting for a copy of a signed delivery
note from the carrier. I'm guessing it got sent to the wrong address. I will wait for 3 more days
& if I have not heard back from them I will send you another one.
Kind regards,''

Last Tuesday (9th) I received this message via eBay's dispute system;
Apologies we have found out that the post code that the carrier had was incorrect.
Can you please confirm your correct address & post code ASAP. We will then send out another item for you.
Also, can we have a daytime contact telephone number?
Our carrier will then contact you if they have the same problem.
I gave them a contact No: straight away, but have heard nothing since, (the carrier is supposed to be Parcelforce 48)
If I report this seller to the eBay Trust & Safety team, what can eBay do???
