What should I do

Would appreciate forum's help please.

I bought a bottle of body lotion described as follows:

300ml Molton Brown Body Lotion
Item condition:
New Other (see details)
"New from a gift set so no box"

And in the description:
Excellent condition and unused. 300 ml . Fragrance is Black Peppercorn. Got as part of a set of 6 on eBay and not sure if authentic. However I used the body washes and they seemed ok


The contents of the bottle are definitely not Molton Brown Black Peppercorn. I know, because I have some from Molton Brown. The bottle which arrived also has an old style screw cap, rather than the pump dispenser which comes with Molton Brown bottles. I'm sure the original contents have been replaced with a cheap body lotion.

Because seller has said she is 'not sure if authentic', do I have a case for asking for a refund as it is not Molton Brown, or do I just put it down to experience?

    If they were not sure it was Molton Brown they should not have mentioned that brand name in the listing.

    If your unhappy contact the seller for a return and just open an INR case if they dont offer to get it returned.

    Thanks, that's what I thought. She's selling it as Molton Brown, in a Molton Brown bottle. Just wondered if her comment was enough for her to get away with it.

    INR? Item not received? But I have received something - just that its not Molton Brown. I'm a bit confused.

    If I do ask for a refund, because it isn't Molton Brown, do I have to pay for return postage?

    Sorry for all the questions. I do use eBay quite a lot to buy, but mostly from shop type sellers and have had very few problems.

    A SNAD claim might be more appropriate, but a seller selling something that they admit might be 'fake' is surely not a seller that is to be trusted.

    Molton Brown 300ml body lotions don't always have pumps. So that alone isn't proof that it's bonafide or fake.

    A seller cannot sell an item as "x" with the caveat it might not be because "it seems ok".

    If you bought Molton Brown and you believe it is fake you need to offer some evidence (and the lack of a pump is not sufficient proof) to show it's fake.

    Or, you opt to return it as a "change of mind" in which case you pay the returns postage.

    I agree, it sounds like the pre-empting a problem and trying to wriggle out of it before the sale was even made. But I'm afraid that wont wash. Get your SNAD claim for that lotion... in motion... :D

As I said, I buy a lot of Molton Brown and every bottle of body lotion I've bought from MB since they changes the names of their wash & body lotions (eg Recharge Black Pepper to Black Peppercorn around 3 years ago) have come with a pump. However, the main problem is because it smells nothing like the original.

    However, I'm certain it is not genuine Molton Brown Black Peppercorn Body Lotion.
    I buy a lot of Molton Brown products and and have some of this already. The stuff which arrived today doesn't smell anything like the original. Mine from MB also came with a pump dispenser lid, rather than the screw top on your bottle.
    I think the bottle has been re filled with some cheap lotion and should not be sold as Molton Brown.
    I thought I'd contact you before I take this up through eBay.

    'I did state on the description that there was doubt of authenticity. I purchased originally as part of a set from e bay and was unsure myself if they were genuine. However, I stated this clearly in the description.

    I don't think its worth the hassle. But if I don't, what feedback should I leave?

    You don't have to provide proof that it smells different. Just open the case.

    The fact that she stated that it may not be genuine is not something that she wants flagged up with ebay and certainly will not sway ebay in her favour.

    She will be forced to accept a return and pay return postage.

    Don't let her away with it.

    I would also hold off on feedback until the matter is resolved.

    She really doesn't understand she should not be selling items which she cannot authenticate.

    With counterfeit claims, ebay generally want you to provide some evidence that the item isn't genuine and your nose isn't sufficient! A strong indicator will be a letter from an authorised seller confirming it isn't genuine.
    Counterfeit items

    If a buyer suspects that an item is counterfeit and there are strong indicators that the item is counterfeit, the buyer isn’t required to return the item to the seller. The buyer agrees to cooperate with us to ensure the proper disposal of the item. In such cases, we refund the buyer for the full cost of the item and original postage, and the seller reimburses us for the refund. The buyer may not sell the item on eBay or elsewhere.

    Can you take it to an MB reseller and ask them to verify it is counterfeit?

    Alternatively, you could just open the case and ring Ebay and ask them to review your messages where she confirms it may not be genuine.
