    It's not the going forward that would be the issue, it is the going back. As in, for the past ten years (?) your mother has been receiving about £4.5k a year in HB for her rent, handing over £1.8k a year to you, and pocketing the difference. If I was you, I'd be more worried about the council finding out about that little scheme, than worrying about council tax.

    A criminal conviction for fraud might well be a bigger problem.

    You are not supposed to hide things from HMRC even if you think that you have no tax liability. It upsets them, and makes them wonder what else you might be up to.

    The point is how do they know this. she could of withdrawn the money and paid me cash every month etc etc so their is no proof she has not gave it me she is my mum and could pay me the cash every month and i spend it so their is no issue, this is not a fraud issue. From now on i will take the full money off her and pay her some cash back to help her live with bills etc

    plus its a expense to me my mortgage is £400 ish if i took whole amount £350 i am still £50 out of pocket without all other costs i incuur. gardeners, home insurance etc etc

    If i put myself on the council tax at my girlfriend will they not ask me why i havent paid council tax for all this time? i do not want a 15 year bill!!!
    And presumably she has been claiming single person's relief all this time, eh ;)

    makes no odds as i stay all over the place my dads, partners and friends near were i work, i am not a benefit fraud i am just getting punished for keeping my mum in a house as i care about her. I will puth er in a council house then and let them maintain it like every other immigrant and single mum

    I think everyone is missing the point here. If you stay at one address, i.e. your girlfriends, more often than not, that would be the address to register on the voters roll. Move all your mail etc to that address, inform your bank etc. The voters roll won't come asking where you've been for the past 15 years and the same goes for any LA. They might want to know your previous address and how long you've lived at the property. Explain you've sofa surfed between friends and family, travelling etc. for X years and this is now your permanent address.

    If the LA know your mum rents the house from you, her son, there is no issue. If they had any reason to doubt the amount she was paying in rent to you they would be questioning it already. While not completely honest I get that you're trying to help your mum out by not taking the full housing benefit from her. But to keep both of you in the right, it may be worth while you taking the full amount on a monthly basis and helping her out in other ways. Such as paying for her shopping etc :-)
