PPI Claim on Dorothy Perkins & Topshop store cards

1st post on the forum so here i go............

My wife had PPI on two store cards (Dorothy Perkins & Topshop) from the 90's & 00's and we have the account numbers and statements and proof of PPI having been paid.

The problem we have had is getting one of the card providers (underwriters etc) to take responsibility for even reviewing or processing a possible PPI claim.

  • We wrote to Santander initially for both cards and eventually after a few letters and a request for £10 paid the £10 fee for them to tell us we should write to Newday.
  • We wrote to Newday and they said they don't deal with the PPI write to Santander as they now handle the old store cards.
  • We also wrote to Genworth lifestyle protection who we were told were underwriters for topshop / Dorothy Perkins and again were referred back to Santander as they now handle the old store cards.
Not wanting to unnecessarily have to re-write and pay another fee to Santander again, has anyone pinned down who is responsible for old Dorothy Perkins & Topshop store card PPI Claims.

Any help would be appreciated as my wife held these cards and paid PPI for around 15 years and believes she was miss-sold it and is owed something back.

    Why does she believe she was miss sold and does she have evidence to back that belief up.
    And also bear in mind that regulation of the Ppi industry only came into force in 2005 so any taken out before that they can just reject out of hand .

    If you do find someone who'll take responsibility, what complaints would your wife make, regarding mis-selling?

    The £10 payment is for a copy of all the records they hold on you, it's only payable once and isn't necessary for a PPI complaint in the majority of cases

    Yes, Santander are currently paying out on these old store cards as they have taken on the liability from the then Arcadia Group (DP, Debenhams, Top Man, Miss Selfridge, etc).


    The Santander PPI team are helpful and can often provide account details over the 'phone by searching on the name and address at the time, so you shouldn't need to pay a fee.

    Please be polite to OPs and remember this is a site for Claimants and Appellants to seek redress against their bank, ex-boss or retailer. If they wanted morality or the view of the IoD or Bank they'd ask them.

    If you're getting passed back and forth between Santander and NewDay then it may be worth calling instead of writing (as suggested above).

    The fact the sale took place pre-2005 isn't necessarily a barrier to you complaining. 2005 is when the then FSA took over regulation of insurance, but that doesn't mean that before then sellers of insurance didn't need to adhere to standards.

    Pre-FSA there was GISC, and before that there was the ABI code. See the FOS page on this.

    Sellers who subscribed to the GISC were and are covered by the FOS.

  • Mersey is spot on.
    I had store cards with Principles, House of Fraser and Debenhams, which were taken out in the mid 90's. Santander has taken responsibility for the Acadia Group, and paid out on my claim. I telephoned, they swiftly sent out forms for me to complete and I outlined why I believed I had been missold, and within a few month had upheld my claim. Very friendly staff, who were easy to deal with.

    Just be clear and consise as to why you believe you were missold the policy when completeing your documentsrion.

    I'm pretty sure some catalogue companies were GISC subscribers. It's worth the OP trying in any event.

    Store card and catalogue companies were not governed by GISC and only became regulated for the sale of insurance in January 2005. Any sale prior to that they can (and do) reject on that basis.

    I agree the OP needs to follow the advice you've mentioned. I'm also happy to accept that I could be wrong, but I'm pretty sure some (not all) catalogue shopping companies were GISC members/subscribers.

    If that's not the case then I don't know how to explain published FOS decisions which deal with catalogue shopping PPI which was sold before 2005.

    I'm not sure about store cards so I'll assume you're right about that!
