Talk mobile damaged credit rating

Hoping someone can help me out??

Do you have the right to cancel a phone contract outside the 14 day cancellation period if they do not send you the SIM card you need to use the phone/contract???

Back in 2015 I took out a talkmobile contract for my 11 year old son's phone, I contacted them in December and change the contract to a rolling pay as you go contract, as he was having a new phone for xmas we need a nano sim, they assured me the sim would arrive in 5 days. What with being busy with xmas arrangements I completely forget the sim still hadn't arrived ... so we had one very disappointed boy on xmas day :(
So I called them up and explained i wanted to cancel the contract as they had failed to provide me with the goods I needed to use their service.. i was told I was a few days out side their 14 day cancellation period so I would have to pay £65 to cancel it, after speaking with many different call handlers i told them i would not be paying any cancellation fee for a service I could not use due to them not providing me with the sim. So that was that I had no further direct debts taken or any communication with them...Fast forward to yesterday I checked by full credit rating baffled as to why it had gone for very good to very poor and it seems they have been marking me as missed payment every month for the last year!!! :mad: I m am so so angry..

So back to my question do I have a case here? If so is it possible to get this removed from my credit rating... if I don't and I have to pay it, how long will this affect my credit rating

    If Talkmobile told you that there would be no cancellation charge you need to contact them straight away because they are the ones who can adjust your credit rating back to where it should be.

    It would be better if you put everything down in writing rather than a telephone call because if you need to take it further it will make your case much easier to sort out.

    The trouble is you where told that there was a £65 cancel fee did you tell them you didn't want to stay?

    Did you close the direct debit down? if you did then they have been trying to take the money but it wouldn't be there so they would put a mark on you credit file every time you didn't pay them.

    Have you not been sent any letters from them?

    Sorry but to be honest i don't think they will take missed payments off of your credit report so you will be stuck for 6yrs with it on
